Comment les politiques visant l’emploi des personnes handicapées prennent-elles en compte le genre ? À partir d’un travail de revue de littérature et de deux enquêtes par méthodes mixtes, cet article propose trois contributions essentielles à la réflexion. Tout d’abord, sur le plan historique, les politiques visant l’emploi des personnes handicapées ont été fondées sur un modèle de travailleur masculin, héritier notamment de la figure du mutilé de guerre. Ensuite, cet héritage a des conséquences différenciées selon le sexe, en dépit d’une neutralisation formelle des politiques sur le plan du genre, du fait des types de handicap que ces politiques ciblent en priorité. Enfin, se reproduisent au sein des politiques visant les « travailleurs handicapés » des inégalités de genre classique, liées par exemple à une attente de disponibilité totale pour la recherche d’emploi, ou encore à une hiérarchie sexuée des métiers au sein du travail protégé.
Le milieu protégé est un secteur d'activité créé dans les années 1950 par des associations de parents et proches de personnes handicapées 1 . Formé par les Établissements et services d'aide par le travail (ESAT) 2 , il emploie des personnes handicapées catégorisées comme n'ayant pas une capacité de travail suffisante pour être employées en milieu ordinaire de travail (encadré 1).Auparavant en constante expansion (Makdessi & Mainguené, 2010), le nombre de places en milieu protégé est resté stable depuis 2013. Les politiques publiques concernant l'emploi des personnes handicapées promeuvent aujourd'hui en priorité l'emploi direct en milieu ordinaire. En témoigne la loi « Avenir Professionnel » du 5 septembre 2018 : alors que depuis 1987, les entreprises pouvaient s'acquitter de l'Obligation d'emploi des travailleurs handicapés (OETH) en passant des contrats de sous-traitance avec les ESAT, cette modalité n'est plus décomptée dans l'emploi au titre de l'OETH. En tant qu'établissements médico-sociaux, les Établissements et services d'aide par le travail (ESAT) relèvent du Code de l'action sociale et des familles, et non du Code du travail (à l'exception des réglementations sur l'hygiène, la sécurité et la médecine du travail). Les personnes handicapées ont donc le statut d'usager•ère au sein de l'établissement. Elles y sont orientées par la Maison départementale des personnes handicapées (MDPH). Elles signent un contrat de soutien et d'aide par le travail, et ne peuvent être licenciées que par un recours exceptionnel à la MDPH.
