Licitação sustentável é o procedimento realizado pelos entes públicos que busca minimizar os impactos ambientais decorrentesdas aquisições e contratações. A administração pública tem o dever de pautar suas condutas no procedimento licitatório visandoà promoção do desenvolvimento sustentável. Esse dever não está relacionado apenas a aspectos econômicos, mas também se refere a aspectos sociais e ambientais. A licitação sustentável busca conciliar estes diferentes aspectos mencionados, de maneira que a administração demonstre responsabilidade socioambiental em suas aquisições e contratações. Este artigo apresenta os principais conceitos e dispositivos legais acerca deste tema. A pesquisa consiste em um estudo de caso realizado a partir de uma abordagemqualitativa e demonstra como tem sido a implementação das práticas sustentáveis de licitação e da execução de políticas de logística reversa de resíduos com potencial altamente prejudicial ao meio ambiente, pelo Tribunal Regional do Trabalho (TRT), 14ª Região, no município de Porto Velho, Rondônia. O TRT da 14ª Região,seguindo orientações internas, tem adotado gradativamente iniciativas que promovam a sustentabilidade, adequando seus processos licitatóriosà responsabilidade socioambiental. Como a legislação que trata do tema pode de certa forma, ser considerada recente, verifica-seque ainda há muito a avançar para que as práticas sustentáveis de licitação sejam incorporadas no cotidiano da administração pública,o importante é que os primeiros passos foram dados.
Purpose: This article aims to present the scientific production inherent to the subject of sustainable public procurement from documents surveyed in the Web of Science (WoS) database. Theoretical framework: the work was based on understanding how the public procurement theme is correlated with sustainability and how, in quantitative levels, the scientific production addresses this issue. Method/design/approach: The research was exploratory with a qualitative approach in which a structured mapping was performed, by means of the bibliometric method, on the scientific articles in WoS in the last five years. Results and conclusion: as a result of the research, it was analyzed that the authors with the highest production on the subject are not necessarily the most cited, with only one occurrence. Other results were a great diversity of theories/models used by the selected authors. And they were obtained with the help of the R Program - Bibliometrix. Research implications: the research makes explicit, through its results, both the relevance of the authors and the scientific production that these researchers are producing on sustainable public procurement. Another implication is the survey of the theories used for the studies on the theme. Originality/value: as this is an unprecedented study, the research sought to present to the scientific community the importance of what is currently being produced on the subject of sustainable public procurement, providing managers and researchers with the most current sources and main authors on the subject.
This study was intended to assess whether the bidding notices of Cerejeiras and Cabixi had put regional development foward, under the terms of Complementary Law 123/2006. The research is exploratory, quantitative, with a longitudinal cut, based on the bidding notices from the health and education departments, which were carried out in 2017 and 2018, extracted from transparency portals of the studied towns. The notices were organized and classified in a table, identifying each one of the items covered by the Complementary Law, comparing them with the law and what is contained in the notices. It was checked that the city halls apparently have little knowledge or clarification about the application of the law, since its public notices establish more tiebreakers criteria for Micro and Small Enterprises (MSEs) than other benefits allowed by law. It was also observed that the provided parts by law are not used. The construction contract notices did not provide for the subcontracting of MSEs. Most notices presented the preference for hiring local and regional companies incorrectly. There were no notices with quotas for the exclusive supply of MSEs in bids for goods of a divisible nature. In addition, it was noted that public agents from these towns need training related to the topic to apply the law and thus foster regional development correctly. A pesquisa buscou analisar as práticas de governança pública imprimidas no âmbito do Estado de Rondônia pelo Programa de Modernização e Governança das Fazendas Municipais de Rondônia e do Desenvolvimento Econômico-Sustentável dos Municípios (PROFAZ), criado por meio da Lei nº 4.222 de 18 de dezembro de 2017. Para a tarefa, procedeu-se revisão da literatura, do arcabouço legal, bem como, mapeamento das ações e práticas de governança pública que foram lançadas e implementadas pelo PROFAZ, as quais irradiaram efeitos nos entes federados do Estado, em especial na tributação do Imposto sobre Serviço de Qualquer Natureza (ISSQN). Os resultados indicaram que houve evolução da arrecadação dos municípios que adotaram a cumplicidade governativa proposta pelo PROFAZ em escala superior àqueles que não trouxeram qualquer alteração.
