УВОДСвако правило које је прихваћено у заједници, које карактеришу сле-дећа обележја: значај, начин доношења правила морала, природа моралне одговорности, облик притиска морала је правило морала, а сва она заједно представљају "морал" заједнице 1 Очито је да морал, у том смислу није уте-----------* Овај чланак је разултат истраживачког рада у оквиру пројеката бр. 179046 "Заштита људских и мањинских права у европском правном простору" Правног факултета у Нишу који финансира Министарство за науку и технолошки развој Републике Србије.1 Питања јавног морала или морала заједнице су изнад права. На пример, права штета од порнографије није како неки сматрају то што вређа људе, већ што вређа основне дру-штвене институције, као што је брак. О томе исцрпније видети у: R. P. Под јавним морамо ми подразумевамо не само права и слободе, него зах-тев за бољим животом заједнице, који би зато морао да буде подупрет правом. О томе де-таљније видети у: H. M. Clor, The Death of Public Morality, The American Journal of Jurispru-Др Марко Трајковић, Право и морал у светлу прихватања и принуде (стр. 257-269) 258 мељен само у аутономним принципима моралног делатника, него на чиње-ници о постојању прихваћених правила у заједници.2 Тај друштвени морал се може назвати "позитивни морал", како га Харт назива у раду "Право, слобода и моралност".3 У његовом одређењу, полази се од терминологије којој су били склони утилитаристи, која разликује позитивни морал, морал стварно прихваћен и заједнички датој друштвеној групи, од општих мо-ралних принципа који се употребљавају у критици постојећих друштвених институција, укључујући и позитивни морал. Такве опште принципе мо-жемо назвати "критичким моралом". ДРУГАЧИЈА СПОЗНАЈА ПРИХВАЋЕНОГ МОРАЛАРазликовање између "позитивног" и "критичког" морала, полази од претпоставке о могућности моралне критике самог морала.4 Даље, посма-трање морала води нас преко граница обавеза и идеала признатих одређеној друштвеној групи, према принципима и идеалима који се употребљавају у моралној критици саме заједнице, па ипак и ту остају значајне везе с темељ-ним обликом друштвеног морала. Увек је могуће да ћемо открити много то-га што треба критиковати, када почнемо да истражујемо прихваћени морал у нашој властитој или у некој другој заједници. Тада се у светлу спознаја с којима располажемо он може показати непотребно репресивним, окрутним или непросвећеним. Може сметати људској слободи.5 Постојећи морал дру-штва може проширити своју заштиту од зла само на његове властите при-паднике или само на одређене класе, остављајући остале обесправљеним. У том типу критике, коју би требало признати као моралну критику импли-цитно је присутна претпоставка да друштвени пореци, укључујући прихва-ћени морал, морају да испуњавају два формална услова -рационалност и генералност. Таква критика имплицира, да се друштвени поредак не би смео 259 темељити на уверењима за која се може показати да су погрешна а...
Social peace, as a system of values, is based on the value of solidarity, which must embody a progressive development of humankind towards a unity that is both genuine and realistic in terms of attaining the desired objectives. Social values, such as solidarity, are of huge significance for social peace. They are particularly necessary in the process of building institutions that can maintain social peace without pressure or coercion. Yet, it does not imply superficial affection and sympathy for the human predicament but a sincere and committed advocacy for the general well-being. Thus, if we can raise man’s awareness and sensitivity to social values, we are likely to develop legal institutions that will not only preserve but also attain social peace based on the highest social values. A reasonable approach to this matter entails that the development of such institutions will not lead (with absolute certainty) to establishing a value system based on social peace, but it will certainly lead to identifying the undesirable state of affairs, which is the direct opposite of social peace and a trigger for moving forward.The concept of solidarity which recognizes that individuals can survive in a holistic environment in spite of their specificities leads to the desired social peace; supported by the multi-perspective relationship between “myself” and “others”, it will suppress man’s inherent egoism, and shed a new light on the value-oriented track of being that has no alternative.Thus defined, social peace turns into a value system which may also be designated as an axiological track of moral conduct, eventually leading to "the logic of the heart" (Blaise Pascal) and "the order of the heart" (Max Scheler). Admittedly, it makes social peace somewhat idyllic but not unattainable because a value system, including social peace as a highest value, is a given constant which is governed by its own laws; thus, it cannot be destroyed by immoral and unlawful conduct.This postulate gives law the necessary axiological critical edge. In times of growing legal positivism which can substantiate anything as long as it has the form of law, it will contribute to distinguishing between the acceptable value system, such as social peace, and its antipodes. Establishing a balance within a legal order enables the law to come closer to the ideal of justice, which will suppress man’s inherent egoism (by referring to “others” rather than “myself”) and enable the exercise of common interests.In the context of legal positivism per se, social peace is guaranteed by the rights which are ensured by the monopoly of physical coercion. However, as such, it is not absolutely acceptable because it entails an element of force which may be interpreted as coercion for the sake of (social) peace of the ruling class. As opposed to such a conception of social peace, the axiological stance is that social peace is a value system which does not retreat in times of adversity but steadily progresses, thus defying the evil that coexists with values in all human matters.

Solidarity as a social and legal value has a special place in the development of every legal order, because it fits into its de facto framework. In terms of this factual aspect, solidarity also entails the behaviour of people, which is based not only on legal norms but also on a plethora of social norms. Thus, it may be assumed that solidarity is a genuine expression of the moral value of perceiving others as oneself, i.e. developing the concept of brotherhood. Such a conceptual framework of solidarity indicates its future application and incorporation into legal systems, particularly those aspiring to longevity which will not be sustained by a highly centralised structure, but by stronger pillars, one of which is solidarity. Throughout the course of history, the concept of solidarity has had different features and boundaries. At times, its application was highly disputable, but it has not affected the substance of this moral value because it is a categorical imperative. The very fact that it is a universal (unconditional) moral value rather than a designated (goal-driven) endeavour enables people to accept or to reject it. Such a concept of solidarity gives birth to a value-based social and legal order, based on social justice and care for others, which are accomplished through social welfare legislation.
Sažetak: Da li je koegzistencija prava i zla mogućnost ili nužda, s obzirom na to da je pravo imperativ, te kao takvo i samo predstavlja mogućnost zla? U pitanju moguće koegzistencije prava i zla sadržano je i pitanje obavezujuće snage samog prava. Ako se obavezujuća snaga prava nalazi isključivo u sankciji, koja se u pravu pojavljuje zbog njegovog heteronomnog karaktera, onda takav pravni sistem ne može da pledira na dugotrajnost. Dakle, zlo koje postoji ne može biti iskorenjeno isključivo pravnim sankcijama, već pravom koje počiva na vrednostima. Ta aksiološka strana postojanja prava omogućava da se zlo najpre smanji i u tom umanjenju možda i nestane. Kao problem u ovom odnosu pojavljuje se i to što i samo pravo može biti izvor nemerljivog zla, te se celo pitanje još više komplikuje, jer je onda kompromitovano pravo koje valja da bude sredstvo i brana od zla.
