O artigo é uma reflexão da dogmática do direito civil e direito processual civil, com especial enfoque na análise de jurisprudência do TRF-1, utilizando o método de análise de discurso. O CNJ reconhece que o conflito agrário tem peculiaridades que exigem que o magistrado seja sensível às especificidades desse tipo de disputa. Essa é a base da necessidade de análise do cumprimento da função social como um pré-requisito para a concessão da tutela possessória, apesar da falta de uma disposição expressa nesse sentido. Foi possível comprovar que os tribunais têm feito esse tipo de exame, mas apenas quando o resultado é favorável para o proprietário. Conclui-se que a ampliação do papel da função social na análise do merecimento de tutela possessória materializa o olhar diferenciado que o CNJ espera que o juiz agrário tenha, possibilitando a justa resolução dos conflitos de terra.
ResumoTrata-se de uma investigação por amostragem não probabilística do tipo intencional pura, abarcando elementos de teoria do direito, direito civil e direito constitucional e os estudos concernentes ao ensino jurídico. O objetivo inicial é desenvolver a conexão entre o "modelo de parecer", tal qual pensado por Marcos Nobre, e a argumentação por autoridade, pensada por José Rodrigo Rodriguez, explicitando a dimensão "opinativa" existente na dinâmica argumentativa utilizada por uma parte não desprezível da dogmática jurídica brasileira. Feito o desenvolvimento, será possível investigar como o viés "opinativo" de parte da produção acadêmica dedicada ao tema da função social da propriedade -aqui tomada como exemplo -, produz uma visão distorcida do princípio constitucional. O primeiro tópico do trabalho tem como objetivo demonstrar que, para que a fundamentação da necessidade de harmonização entre o Direito Civil e os ditames constitucionais seja consistente, a escola civil-constitucional não pode se apoiar somente no direito positivo. Isso porque a fonte de dissenso acerca de qual seja a visão correta do Direito Civil é justamente decorrente das diversas formas que a interpretação da legislação pode assumir a partir dos valores que podem ser considerados como relevantes. Nesse sentido, o segundo tópico pretende demonstrar que a base que diferencia essa metodologia das demais é a sua fundamentação mais de acordo com as exigências próprias da filosofia moral, e é preciso assumi-la de forma clara, sob pena de enfraquecimento da proposta. Esse é o caminho pelo qual é possível perceber que o Direito Civil, contemporaneamente, precisa não apenas “tomar pé” das discussões que são empreendidas em outras áreas do conhecimento jurídico e filosófico, conforme demonstrado no terceiro tópico do trabalho, mas assumir a temática filosófica como fonte de elementos necessários para a compreensão do próprio objeto do Direito Civil. Trata-se de uma relação para além da concepção tradicional de interdisciplinaridade e passa à condição de novo campo de compreensão da disciplina.
O artigo tem como objetivo contestar a idéia de que os vícios objetivos e subjetivos da posse são independentes, tendo em vista as próprias definições de vícios com as quais a doutrina costuma trabalhar. Essa contestação é feita também através do exame dos exemplos normalmente utilizados pela doutrina para a defesa da independência. Ao final, será demonstrado que, mesmo considerando a tese da independência através do exemplo padrão da aquisição a non domino, não seria possível obter os efeitos que normalmente se espera por esse caminho. Em última instância, os vícios subjetivos dependem necessariamente da presença de um vício objetivo para que possam fazer sentido.
