A Lei nº 13.125, de 2015, promulgada na vigência da Constituição Federal de 1988 e da Convenção nº 169 da Organização Internacional do Trabalho, é objeto de discussões desde a sua entrada em vigor. Questiona-se, particularmente, se a norma estaria em desacordo com o disposto naquele Tratado Internacional. Sob o aspecto formal, as críticas postulam que os povos indígenas, comunidades e agricultores tradicionais, teriam sido excluídos do processo legislativo. Com relação ao conteúdo, há controvérsias em pontos específicos. Por exemplo, haveria inconvencionalidade quando a lei diferencia os conhecimentos tradicionais de origem identificável e os de origem não identificável, exigindo o consentimento prévio apenas com relação aos primeiros. Esta pesquisa teve por objetivo apurar em que medida a Lei nº 13.123/2015 atende, com relação aos direitos de consulta e de consentimento prévio livre e informado, ao disposto na Convenção nº 169 da OIT, bem como avaliar as consequências e possibilidades em termos de controle jurisdicional de convencionalidade. A pesquisa foi elaborada utilizando-se o método de abordagem hipotético-dedutivo e o método de procedimento monográfico. As técnicas de pesquisa foram a bibliográfica e a legislativa. Concluiu-se que a criação da lei sem observância ao disposto no Tratado Internacional, excluindo-se os interessados do seu processo de formação, possibilita que a norma seja questionada tanto perante o Direito Internacional, mediante denúncia do Estado Brasileiro à OIT, quanto no âmbito doméstico, pela via do controle difuso de convencionalidade.
As abordagens acerca do comum tradicionalmente estão atreladas à ideia de propriedade, atribuindose àquele um caráter meramente residual. Essa fórmula não tem mais lugar, pois os recursos ambientais abarcados pelo conceito do comum não se definem em termos de propriedade justamente em face de seu caráter indisponível. O presente estudo busca, pois, estabelecer a natureza jurídica dos recursos ambientais comuns, averiguando sua origem e principais características. A metodologia utilizada no trabalho é a básica-qualitativa, e com relação aos procedimentos técnicos, realiza-se pesquisa bibliográfica, procedendo-se ao levantamento de material já publicado sobre o tema disponível em livros, periódicos, documentos, textos e material disponibilizado na internet. A conclusão a que se chega, após a realização da pesquisa, foi de que o comum é autônomo, traduzindose no princípio de um novo direito, e se apresentando como alternativa ao direito de propriedade. Os bens comuns possuem natureza jurídica de bens inapropriáveis, sendo, no entanto, passíveis de regulação.
