Este artigo se destina ao estudo da aplicação da proporcionalidade como critério de definição dos limites da atuação das Agências na competência de regulação. O objetivo geral é estabelecer a teoria geral dos direitos fundamentais como limite para supremacia do interesse público quando da atividade regulatória das Agências. A primeira hipótese construída é a de que essa supremacia somente encontrará legitimidade no texto constitucional quando voltada à consecução dos direitos fundamentais. Outra hipótese defendida é a de que os atos de regulação das Agências violam o texto constitucional quando sob o fundamento da supremacia do interesse público e da garantia dos interesses da coletividade que afastem a proteção constitucional dada aos direitos fundamentais. Na proposta defendida, a supremacia somente terá fundamento constitucional a partir do sopesamento pelo critério da proporcionalidade, entre os interesses da coletividade e os direitos fundamentais.
