El artículo recorre la evolución de temas centrales en las relaciones de género en las constituciones peruanas durante casi un siglo, de 1931 al 2021. Analiza el camino recorrido desde la exclusión de las mujeres como ciudadanas hasta la conquista de la paridad en la participación política; la transformación de la cláusula de igualdad hasta convertirse en una con la potencialidad de incorporar la discriminación por orientación sexual como categoría prohibida; así como los cambios en la concepción de la protección a la maternidad por parte del Estado, hasta llegar a una formulación que reconoce el derecho de las personas de forma individual a decidir sobre su capacidad reproductiva. El artículo da cuenta también de la participación de las mujeres en la lucha por estas conquistas, de sus iniciativas tanto en espacios formales como informales, así como de los postulados de los movimientos feministas de primera y segunda ola. Todo ello organizado a partir de las categorías acuñadas por Ruth Rubio Marín para entender el constitucionalismo en clave de género: constitucionalismo excluyente, inclusivo, participativo y transformador.
En el presente artículo, las autoras analizan la respuesta del Estado peruano a través de la implementación de diversas políticas públicas con el objetivo de contrarrestar la violencia contra las mujeres e integrantes del grupo familiar fortalecida y desencadenada por el contexto de la pandemia del COVID-19.
Primero, las autoras estudian las medidas tomadas de manera inmediata por el Estado peruano durante el inicio de la pandemia y las sitúan en el contexto latinoamericano mediante una perspectiva comparada. En un segundo momento, tales medidas se analizan con el fin de hacer un balance entre los límites y logros en su implementación efectiva durante el primer año de la pandemia.
contra la mujer (CEDAW), dada a inicios de los 80, se enmarca en un proceso de transición no sólo política sino entre dos generaciones de mujeres activistas. Una de ellas es el grupo de mujeres profesionales, que luego de la conquista del voto han sido llamadas a participar en la vida política, como Matilde Pérez Palacio, primera abogada PUCP y luego diputada por Acción Popular, y otras que han fundado organizaciones no gubernamentales de protección a la infancia y a la madre abandonada como María Vita de Álvarez. Destacadas profesionales vinculadas siempre al Consejo Nacional de Mujeres, creado en 1923, como Sara Pérez Palacio, Olga Paredes Lañas de De Olarte y muchas más. Esta generación de mujeres, entre las cuales encontramos un importante contingente de abogadas PUCP, es a la que les toca dar opinión positiva para la ratificación de la CEDAW, lo cual hacen desde sus instituciones, pero sin acallar la crítica que les merece la situación de postergación que vivían las mujeres. Por otro lado, una siguiente generación de mujeres activistas de la segunda ola del movimiento feminista peruano es quien reivindicará la CEDAW años después, y a las que les tocará en su momento asumir la responsabilidad pública y política, como les tocó a la generación que las antecedió.
Este capítulo caracteriza desde una perspectiva de género a las familias de los y las jóvenes venezolanas que participaron del estudio, y su posible necesidad de reunificación (parejas, hijos, hijas, madres, padres, etc.). Para ello, la autora revisa la definición de familia como un fenómeno dinámico cuyas formas de organización son diversas y se encuentran al amparo del marco político normativo. De acuerdo con la Constitución peruana de 1993, el Estado protege a la familia y, por tanto, las políticas y el marco normativo deben responder a las necesidades de los diversos tipos de familia. De esta misma forma lo comprende el Tribunal Constitucional (TC) peruano, el mismo que en sendas resoluciones reconoce que los cambios sociales y jurídicos han generado que la estructura familiar tradicional (nuclear) deje de ser el statu quo y, por tanto, que todos los distintos tipos de estructuras familiares que coexisten en la sociedad merecen la protección estatal. Sin embargo, es necesario contrastar los parámetros establecidos en la normatividad relativa a la «reunificación familiar», enmarcada en un sentido restringido de la familia, es decir, aquella basada en un vínculo matrimonial, filiación y convivencia (uniones de hecho estrictas), para ver cuánto concuerda con la composición familiar de la población migrante y refugiada. Teniendo esto presente el objetivo final del capítulo es identificar posibles desajustes en la normatividad, que sirvan como oportunidad de cuestionar sus márgenes de protección, a la luz de una interpretación más amplia y atendiendo a lo establecido por el TC.
