RESUMEN: En la actualidad, la soberanía estatal está siendo discutida por la existencia de dos fenómenos distintos: En primer lugar el proceso de integración Europea. La Unión absorbe cada vez más competencias sobre las que reclama el poder último de decisión, en aras de conseguir una aplicación homogénea del Derecho en todos los Estados miembros. En segundo lugar, la mayoría de Estados miembros están asistiendo a un proceso de descentralización en su interior. Paradójicamente, uno y otro proceso se influyen recíprocamente.En el moderno Estado Constitucional, el único soberano posible es el Pueblo. Discutir la soberanía estatal implica pues, consecuencias negativas para la democracia.PALABRAS CLAVE: Unión Europea, Soberanía, Legitimidad, Competencias, Derechos Fundamentales.ABSTRACT: Nowadays, state sovereignty is being challenged by the existence of two different phenomena. ResumoO presente estudo pretende analisar as divergências e convergências entre as teorias da constituição de Rudolf Smend e Konrad Hesse, especialmente no que se refere à interpretação dos direitos fundamentais. Considerando-se a relação entre o constitucionalismo e os direitos fundamentais, apresentam-se as ideias prevalentes nas duas teorias citadas no título, para, ao final, avaliar como as teorias de Smend e Hesse não são propriamente contrapostas, especialmente no que diz respeito à interpretação dos direitos fundamentais. A revisão de aspectos das duas teorias poderá ser útil na difícil tarefa de se dar maior eficácia a esses direitos.Palavras-chave: constitucionalismo, direitos fundamentais, Rudolf Smend, Konrad Hesse.

I. INTRODUCCIÓNLos antecedentes y el contexto político de esta sentencia son bien conocidos. En las democracias pluralistas actuales, la confrontación partidaria entre mayorías y minorías ha sustituido los pesos y contrapesos en los que se basaba la clásica doctrina de la separación de poderes. Es en el seno de estas donde la justicia constitucional resulta ser un elemento esencial para garantizar el estatus jurídico de la oposición y dotar de racionalidad a todo el ordenamiento jurídico. Ello solo puede conseguirse a través de lo que es su función más característica: el control de constitucionalidad de las leyes. Un análisis del sistema de justicia constitucional español y de la jurisprudencia emanada de nuestro Tribunal Constitucional en comparación con otros Estados de nuestro entorno muestra que las minorías han podido contar con un cierto nivel de protección en tanto que ostentaban la condición parlamentaria. La mejora de su estatus requiere la aprobación de un “Derecho de la Oposición” y ampliar la legitimación tanto del conflicto entre órganos constitucionales (incluyendo, como en Alemania a facciones de los mismos) como del recurso de inconstitucionalidad (a las minorías autonómicas).
