Resumen. En casi cuarenta años de democracia se ha originado un fenómeno que ha producido efectos contrarios a los buscados: una excesiva proliferación de leyes de educación ha traído una notable y constante inestabilidad legislativa. Se analizan aquí las razones profundas de este fenómeno, especialmente la política de los dos grandes partidos nacionales y su plasmación en las leyes de sus modelos sistémicos de educación, modelos sellados por la ideología respectiva, lo que inevitablemente ha conllevado un cambio legislativo cuando el electorado ha votado la alternancia democrática. Este análisis conduce a la necesidad de un nuevo consenso sobre educación que permita garantizar la aplicación efectiva de las reformas que las leyes impulsan.Palabras clave: Socialdemocracia. El autor analiza la relación existente entre Estado y Educación desde la aparición del Estado Moderno y su evolución. En el Antiguo Régimen, aun existiendo distintos modelos, el Estado es indiferente a la educación, que constituye un monopolio eclesiástico. Esta situación cambia radicalmente con la Revolución Francesa. El Estado asume la gestión directa de la educación que se convierte en un servicio público abierto a todos. Surgen así dos modelos distintos: el liberal o dual que contempla dos tramos educativos, una instrucción elemental y gratuita para el pueblo y otra superior y onerosa para las capas altas; el jacobino o social que propone una instrucción igual para toda la población y es el antecedente de la concepción de la educación como un derecho. Para el autor ambos modelos originan la antítesis entre las tendencias que ven la educación como instrumento de control social y las que la consideran factor de emancipación y cambio social. Tendencias que llegan hasta nuestros días. Finalmente se analizan las dos concepciones contrapuestas de la educación como derecho de libertad, propia del liberalismo, y como derecho social responsabilidad del Estado, reconocida en el Estado del Bienestar y posteriormente en los Pactos Internacionales.
Education policy in Spain, a curricular discipline in the Education Faculties since 1974, has been a foreign body –because of its inevitable connection with political sciences– both in the former Degree in Education and in the current one, a result of the curriculum adaptation to the European Higher Education Area (EHEA). The Degree in Education aims to train teachers, not education-oriented political scientists, but, unlike other similar disciplines –education sociology or education economy– which have managed to find their place in the curriculum as supplementary knowledge, education policy runs the risk of being distorted if we do not root it in the political sciences it stems from. The reflections presented in this paper therefore focus on the three major problems the discipline does not get to resolve: its conceptual indeterminacy, the right nature of this body of knowledge and the lack of canonical boundaries of its knowledge fields.
INTRODUCCIÓN. Este artículo se centra en la creación del sistema educativo nacional impulsada por los liberales de las Cortes de Cádiz y en la posterior frustración de este modelo, producida en la tercera época constitucional, la que se abre con la muerte de Fernando VII. Al comienzo del artículo se marca brevemente el terminus comparationis, esto es, la situación de la educación en el Antiguo Régimen, contrapunto necesario para comprender la extraordinaria innovación que supuso el proyecto de educación nacional desarrollado en el informe de 1813 sobre el nuevo sistema de instrucción pública. MÉTODO. Se sigue un método histórico -fuentes primarias y secundarias del periodo analizado-, estudiándose los textos fundacionales que desarrollaron el sistema de educación nacional, diseñado en el título IX de la Constitución de 1812, al tiempo que se expone la singularidad histórica que representó en España el nuevo sistema. RESULTADOS. El análisis realizado de la evolución histórica que sufrió dicho modelo señala que el sistema educativo nacional, verdaderamente revolucionario para su tiempo, fue sustituido en la tercera época constitucional por otro, un sistema educativo estatal, dando lugar a un proceso que culminó en la ley Moyano de 1857. DISCUSIÓN. Esta conclusión debería abrir nuevos debates entre los investigadores actuales.
