O artigo assume o período escravagista como marco fundacional da tortura no Brasil. Nesta pesquisa, objetiva-se pensar, em uma perspectiva jurídica e histórica, a escravidão como laboratório através do qual foram forjadas práticas posteriores de uso da força pelo Estado e de constituição de políticas de (in)segurança pública que vitimizam, primordialmente, corpos e existências negras. Na tentativa de compreensão substantiva da operacionalização histórica da tortura pelo Estado brasileiro, adotou-se a lente analítica decolonial, com vistas ao adensamento crítico das discussões sobre as práticas de punição e castigo herdadas do regime colonial. Neste sentido, realizou-se pesquisa em fontes primárias documentais, por meio do mapeamento, levantamento e exame de periódicos dos oitocentos que trouxeram à baila a luta abolicionista e as denúncias de práticas de tortura perpetradas contra pessoas escravizadas. Empreendeu-se, ainda, a revisão bibliográfica, com vistas à contribuição para a disputa de sentidos em torno dos conceitos jurídicos de tortura, a partir de considerações históricas.
