ujęciem istoty związania precedensem sądowym jest tzw. (w literaturze anglojęzycznej) koncepcja the rule model. W myśl założeń tej koncepcji precedensowy wyrok sprowadzany jest do ogólnej, generalno-abstrakcyjnej reguły (normy), przypominającej swoją postacią reguły (normy), jakie wyprowadza się z tekstów aktów prawa stanowionego (konstytucji, ustaw, dyrektyw, rozporzą-dzeń, itp.). Przy tym, o ile tylko pozostaje to w zgodzie z zakresem podmiotowym, zasady stare decisis (zasady związania precedensem sądowym) 1 , taka ogólna reguła, zwana zwyczajowo regułą precedensu lub ratio decidendi, ma być wiążąca dla sędziów, którym przyjdzie orzekać w sprawach objętych jej zakresem zastosowania.Taka, ograniczająca się do the rule model, postawa jest jednak całkowicie błędna.
