El derecho de los niños a ser oídos y a que su opinión sea debidamente tomada en cuenta constituye un mandato legal que obliga a los jueces de familia a recoger sus deseos y sentimientos en una amplia gama de materias. Sin embargo, ni la Convención de Derechos del Niño ni la legislación nacional establecen cómo poner en práctica este derecho: ¿Quién debe escucharlos? ¿Desde qué edad en adelante? ¿En qué tipo de asuntos? ¿Con o sin presencia de sus padres o adultos significativos? Estas son algunas de las preguntas que surgen frente a esta temática. Dar a conocer los resultados de un estudio empírico que indaga sobre las formas en que la judicatura de familia recupera la voz de los niños, así como las dificultades y desafíos que entraña la aplicación práctica del derecho a ser oído es el objetivo del presente trabajo.
La dispersión de las reglas civiles, producto de la dictación de legislación complementaria y fragmentaria al Código Civil, generó lo que la doctrina civil ha denominado el fenómeno de la descodificación. Esta expresión refiere el surgimiento de nuevos cuerpos normativos de carácter especial que sustraen sectores completos del Código Civil, relegándolo a la periferia. Determinar si este fenómeno que afecta a las normas civiles se extiende a las normas procesales civiles y, en particular, al Código de Procedimiento Civil chileno, es la temática que se aborda en el presente trabajo.
