Este artigo objetiva estudar em que medida a Nova Lei do Saneamento Básico utiliza o Spending Power, e se esta regulamentação afeta a autonomia federativa municipal para prestar o serviço público de saneamento básico. O trabalho está estruturado em três etapas. A primeira se dedica ao Federalismo na Constituição Federal com ênfase na autonomia federativa municipal para a realização da política pública de saneamento básico. A segunda trata sobre o Spending Power no direito estadunidense, explicando sua definição e delimitando o alcance do instituto. A terceira estuda a regulamentação por meio das Normas de Referência, condicionando a distribuição de recursos orçamentários da União à sua obediência pelos Municípios. Conclui-se que a Lei importa o Spending Power de maneira modificada, porém inconstitucional, pois impede o consentimento informado e voluntário dos municípios porque estes acabam por não ter, na realidade orçamentária brasileira, a legítima e real opção de não aderir às condições impostas pela Lei n. 14.026/20 e futuras regulamentações da ANA.
A vulnerabilidade do consumidor digital é explorada pelas empresas ao imporem termos de uso e cookies em troca do fornecimento de informações essenciais em tempos de pandemia, como notícias de saúde, política e economia. O artigo tem como objetivo geral a análise, por meio do método hipotético-dedutivo e pesquisa teórico-bibliográfica, de natureza transdisciplinar, do impacto da pandemia de Covid-19 no direito fundamental de proteção dos dados dos consumidores digitais no Brasil, focando especialmente no consumo de informações de grandes portais de notícias e na tutela desse direito pelo Estado brasileiro, de viés neoliberal, e como objetivo específico o estudo da possibilidade de agravamento dos riscos quanto ao uso indiscriminado de suas informações sensíveis, bem como pela insuficiente regulação estatal das plataformas eletrônicas, por meio do teste da hipótese de que as plataformas de notícias se apropriam forçadamente dos dados pessoais dos consumidores, ainda mais vulneráveis durante a pandemia de Covid-19. O artigo conclui pelo reconhecimento de uma vulnerabilidade algorítmica do consumidor, bem como pela necessidade de um diálogo de fontes entre a Lei 8.078/90 (Código de Defesa do Consumidor) e 13.809/18 (Lei Geral de Proteção de Dados), sobretudo no âmbito da criação de uma Política Nacional de Dados, através da qual o Estado desempenharia uma importante função reguladora.
