O trabalho aborda a relação entre tributação e cidadania, buscando demostrar, como nos dias atuais, de crise fiscal, podemos compatibilizar estes dois institutos. Discutirá os variados conceitos existentes de Cidadania, Poder de Tributar do Estado e suas limitações, cenário de crise fiscal, bem como discorrerá sobre cidadania tributária e os principais pontos conflitantes entre o Estado e os Contribuintes. Por fim, serão mencionadas medidas já adotadas e outras em vias de implantação, que visam uma reforma tributária onde a sociedade se torne mais consciente, participativa e passe a ser informada sobre a destinação da verba tributada direcionada aos cofres públicos.
O trabalho aborda a incidência do IPI na importação de veículos automotores por pessoa natural para uso próprio. Discutirá características do procedimento de importação, bem como o Imposto de Importação e, assim, analisará o porque da cobrança destes dois tributos na compra de veículos automotores do exterior. Os conceitos bis in idem e bitributação serão debatidos. Hipóteses de incidência do IPI serão estudadas, demonstrando como o importador pode ser enquadrado como sujeito passivo na tributação do IPI na importação, juntamente comparado nos princípios tributários constitucionais. Por fim, será feita reflexão crítica do recente julgado e novo posicionamento do STF.
A busca de tributos é essencial para manter a estrutura do estado. Entretanto, cada vez mais aferem-se distorções seja na quantidade seja no seu enfoque. A tributação brasileira é estruturada no consumo, este tributado em todos os níveis federativos. Buscou-se uma exposição perfunctória sobre a evolução da tributação para delinearmos, mesmo que de forma ainda incipiente, um quadrante histórico da tributação sobre o consumo brasileiro, não deixando de abordar os conceitos e características desta incidência, em seu aspecto geral e jurídico, relacionando, quando possível, com o atual cenário de crise fiscal vivida no país.
