Nos Estados Unidos e, igualmente, na Europa, a história do Direito e Literatura remete ao início do século XX e seus desdobramentos levaram a diferentes abordagens e perspectivas. No Brasil, ao longo da última década, observa-se a multiplicação dos estudos e pesquisas em Direito e Literatura. Isso não significa, porém, que seu surgimento seja recente no território nacional e tampouco que o grande volume das produções intelectuais seja diretamente proporcional à sua qualidade. O presente artigo busca resgatar, historicamente, o modo como se desenvolveu o estudo do Direito e Literatura no Brasil, recuperando seus precursores, reconhecendo os pesquisadores que contribuíram para sua evolução e identificando os aspectos que conduziram à sua expansão. Reflete, ainda, sobre a (in)consistência teórica das pesquisas desenvolvidas, a partir de levantamento quantitativo e análise qualitativa dos trabalhos apresentados e publicados nos eventos do Conpedi. Conclui que, em comparação às tradições estadunidense e europeia, a experiência brasileira revela-se inovadora e promissora, apesar de ainda bastante deficitária do ponto de vista teórico.
A partir dos ensinamentos da corrente que estuda o Direito na Literatura, bem como do emprego da metodologia fenomenológica hermenêutica, o presente ensaio pretende discutir o teor eugênico dos critérios abstratos para doação de material genético adotados no Brasil. Afim de apresentar a questão de forma mais clara para o leitor, será utilizado como exemplo privilegiado a obra Admirável Mundo Novo, de Aldous Huxley. Oportunamente, será trabalho o recente exemplo britânico referente à investigação da conduta adotada pelo London Sperm Bank, ocasião em que foram levantadas importantes críticas a respeito da seleção genética baseada na tentativa de evitar doenças congênitas.
No presente texto, pretende-se abordar o debate de filosofia política entre comunitaristas e liberais e as implicações do mesmo para a teoria do direito. A partir do método dialético, será realizada uma síntese de ambas as posições, não a partir da tentativa de homogeneizar as diversas correntes que constituem tal debate, mas com o intuito de, expondo introdutoriamente a distinta distribuição de peso e prioridade do justo sobre o bem (liberais) e sua possível indiferença aos contextos (comunitaristas), revelar a possibilidade de conciliação entre concepções liberais e comunitaristas, tendo-se em vista os princípios democráticos que as sustentam. Uma vez introduzidas distinções entre as correntes na introdução, estabelece-se, no segundo tópico, a possível relação entre teorias pluralistas do direito e correntes comunitaristas. Como síntese, propõe-se no terceiro tópico uma releitura do conceito de pluralismo jurídico desvinculado do conceito de justiça teleológico relativo aos comunitaristas, mas compatível com os pressupostos teóricos do liberalismo político de Ronald Dworkin.
RESUMO:O debate jurídico tem sido enfeitiçado nos últimos anos com o novo canto da sereia: o uso de algoritmos para auxiliar os juízes em sua prestação jurisdicional, incluindo nesse rol o auxílio na tomada de decisões. Isso é resultado de mudanças profundas sofridas também pelo Direito nos últimos dois séculos, mas principalmente a partir da década de 1990, impulsionadas pela tecnologia. Bem verdade, toda a estrutura e compreensão sobre o mundo vem se transformando e, seguramente, motivada pelo boom da internet. Como em cadeia, essas mutações afetaram o processo comunicativo, a forma de relacionamento entre os sujeitos e, paulatinamente, vêm atingindo o âmbito de atuação do Poder Judiciário. Pretende-se, a partir do emprego do "método" fenomenológico-hermenêutico, demonstrar que, mesmo diante dos avanços promovidos pela tecnologia, não podemos abrir mão das justificações por princípio como trunfos em favor da democracia.
