Actualmente en España una de cada cuatro personas encarceladas está en prisión preventiva, sin que se haya emitido una sentencia firme sobre su culpabilidad. No obstante, destaca el hecho de que el porcentaje de presos preventivos, en relación con los penados, ha disminuido durante los últimos años. Hace un lustro, uno de cada tres presos era preventivo. La reducción indica que, efectivamente, el proceso judicial penal se ha agilizado y que ahora un mayor número de casos se instruyen a través del procedimiento abreviado, lo que ha originado un acortamiento del tiempo de prisión preventiva. Sin embargo, los criterios para la aplicación de la prisión provisional siguen siendo ambiguos.
