O presente estudo tem por objetivo a quantificação dos impactos práticos da decisão do STF no HC 126.292/SP, a partir do levantamento de dados que permitam uma estimativa aproximada de quantos réus respondem por processos penais em tribunais superiores e, por conseguinte, se tornam passíveis de encarceramento imediato. Segundo o último Levantamento Nacional de Informações Penitenciárias produzido pelo Ministério da Justiça, existem atualmente 622.202 presos no país. Segundo levantamento realizado pela equipe do projeto Supremo em Números da FGV Direito Rio, a expedição de mandado de prisão de réus condenados em segunda instância a pena igual ou maior a 8 anos e com recurso tramitando no STF e STJ significaria um aumento de 0,6% no número de apenados no sistema prisional (3.460 novos presos). Longe, portanto, de previsões catastróficas propaladas pelos críticos do novo entendimento do Supremo sobre a execução da pena após condenação em segunda instância.
O presente artigo objetiva estudar as ações afirmativas de reserva de vagas nos concursos para a magistratura nacional a partir da teoria da justiça, analisando sua conformidade com o princípio da igualdade de oportunidades que deve caracterizar as sociedades democráticas contemporâneas. O exame do referencial teórico oferecido por John Rawls, Ronald Dworkin e Amartya Sen permitiu concluir que as regras do Conselho Nacional de Justiça, que tratam da reserva de vagas a pessoas portadores de deficiência, estão em consonância com os princípios de correção de justiça material, porquanto asseguram a justa oportunidade a esse grupo social, em razão da sua incapacidade para desenvolverem, no jogo do mercado, em igualdade de condições, projetos razoáveis de vida. A investigação também concluiu que, nada obstante a propriedade dessas ações afirmativas, algumas questões ainda estão em aberto, como os parâmetros institucionais relativos ao desenvolvimento da carreira, até mesmo por serem recentes essas políticas de discriminação inversa na composição da magistratura.
Resumo-Computação verde é tema central em diversas áreas da computação, incluindo redes de computadores. Soluções dinâmicas capazes de ajustar adequadamente os recursos de uma rede podem evitar o superdimensionamento da infraestrutura e reduzir o consumo energético em momentos de baixa demanda. Neste trabalho, apresentamos o MGTD: um Mecanismo para Gerenciamento de Tráfego Dinâmico ciente do consumo de energia, construído sobre o paradigma de SDN. O MGTD monitora continuamente o uso dos enlaces para concentrar os tráfegos e desligar equipamentos ociosos, sem degradar a qualidade do serviço oferecido. Nossas simulações evidenciam economia média de energia de até 46% em cenário de baixa demanda. Comparando com uma solução típica da literatura, o MGTD é 4% a 7% melhor na média, dependendo do cenário. O presente artigo desenvolve algumas reflexões sobre o Poder Judiciário no Brasil, sob a ótica da análise econômica do Direito (Law and Economics), estabelecendo possíveis relações entre a curva de litigiosidade, o custo dos serviços prestados pelas dezenas de órgãos judiciários e os interesses dos litigantes, em especial os econômicos. Com base na pesquisa bibliográfica e documental, em especial de dados estatísticos fornecidos pelo Conselho Nacional de Justiça, o estudo mostra o nível de litigiosidade, a estrutura e o perfil dos casos novos que são apresentados nos diversos segmentos de Justiça. Examina a litigância na perspectiva de uma racionalidade econômica, em termos de ponderação de custo e benefício, de modo a considerar que nem sempre o espaço judiciário é rejeitado pelo devedor de uma obrigação jurídica. Por fim, aponta a necessidade de uma revisão desse modelo, em razão dos resultados socialmente desfavoráveis, já que as despesas com a manutenção do Poder Judiciário são consideradas elevadas.
