Cet article met en lumière et déconstruit des pratiques locales de ciblage et de traitement particulier de populations vues comme des publics spécifiques de l’action sociale. À partir d’une enquête portant sur la politique de résorption des bidonvilles dans une grande agglomération française, nous démontrerons la mise en œuvre par les pouvoirs publics de parcours différenciés marqués par des pratiques institutionnalisées de non-recours aux droits. Nous proposons ainsi un enrichissement de la grille d’analyse du non-recours (Warin, 2016) en introduisant la notion de « non-recours par interdiction », consistant, dans une temporalité limitée, à interdire l’accès à un ensemble de services dits de droit commun pour des raisons d’ordre à la fois politique et opérationnel. Nous analyserons par ailleurs les réactions et stratégies mises en place par les intervenants sociaux et les personnes concernées par les dispositifs – entre acceptation, contestation, contournement ou neutralisation (Le Bourhis et Lascoumes, 2014). Au-delà des populations ici concernées (familles migrantes reconnues comme Roms européens), nous posons l’hypothèse que ces logiques de ciblage et de non-recours institutionnalisés sont présentes dans un large nombre de secteurs de l’action sociale, posant ainsi la question de l’universalité des droits et de la citoyenneté des destinataires de l’action publique.
Cette contribution met en lumière de nouvelles relations entre État et société civile dans les politiques migratoires locales et, plus particulièrement, dans les politiques d’insertion sociale et économique. À partir d’enquêtes de terrain ethnographiques menées dans trois agglomérations françaises, les auteurs mettent à jour un mouvement d’institutionnalisation progressive de l’action bénévole au sein de l’action publique. Les terrains d’enquête sont des « dispositifs d’insertion » initiés par l’État et confiés à des associations, visant à l’insertion sociale de migrants européens précaires identifiés comme « Roms », vivant en habitat précaire. L’article propose une analyse en deux temps. Un premier temps revient sur le choix des services de l’État de confier à des tiers « opérateurs » la mise en oeuvre de « dispositifs d’insertion », en fixant des orientations notamment en matière de mobilisation de bénévoles. Un second temps concerne les modalités pratiques de cette institutionnalisation du bénévolat dans la réponse publique. L’hypothèse développée en filigrane est celle d’une politique migratoire qui se construit en partie sur des stratégies de canalisation, de mise à distance et d’institutionnalisation d’une action bénévole dépolitisée.
