Until assuming the violent form most strikingly exemplified in France by the explosions of 1789 and 1848, the century-long movement of resistance and emancipation of the European peasantry mainly occurred in the legal domain. The focus of opposition was towards the attempt to impose a normative system which sought to undermine the working rules of peasant communities. It was carried through, for example, by protesting against seignorial obligations or by asserting claims to the free use of forests and communal pastures. In such actions the peasant will, revitalized by periodic subsistence crises, tried to maintain control over legal institutions, and therefore to retain relative social autonomy.

Resumen Y ¿si fuera el derecho una historia romana proyectada por analogía e imperialismo hasta en el seno de las sociedades "primitivas" estudiadas por los antropólogos? el objetivo de este artículo consiste en tomar en consideración la propiedad del derecho de ser él-mismo la ciencia de sus razonamientos y de sus prácticas, lo cual introduce desviaciones recurrentes en las tentativas de estudio antropológico de lo jurídico ya que, para el derecho, lo descriptivo es inseparable de lo prescriptivo. una dificultad epistemológica importante surge con respecto a la confesión indígena, es decir, con respecto al fenómeno mediante el cual unas concepciones culturales locales están formuladas en los términos alienantes sacados del cuerpo jurídico. Más allá de una antropología jurídica dependiente de los montajes jurídicos, la antropología del derecho es necesaria para desvelar dichos montajes y las series de ficciones con las que operan. Ciertamente es así como se puede acceder al derecho como conjunto de conceptos, de lógicas, de instituciones y de prácticas occidentales y occidentalizadas, que caracterizan esta normatividad específica que se presenta como una norma universal.Palabras clave: antropología del derecho; relativismo cultural; confesión indígena. This article's main topic is firstly the capacity of law to be the science of its own rationales and practices, and secondly the biases drove into anthropological thinking while borrowing legal concepts and modes of reasoning. altogether descriptive and prescriptive, the law depicts and organizes human realities in a single move. That thus creates a major epistemological difficulty when and where indigenous confession occurs, i.e. the phenomenon by which local cultural schemes are locally formulated in the alienating terms originated in the legal corpus. beyond a law-dependent legal anthropology, the anthropology of law is aware of the importance of legal fictions and reaches the substance of the law as a western and westernized set of concepts, logics, institutions and practices which characterize a special kind of normativity claiming to represent the universal normativity.
