Los alevines de tilapia nilótica fueron criados en el Centro Agropecuario Miraflores, se crio 3000 unidades de tilapias, estos fueron en un estanque general y luego fueron distribuidos en tres estanques, haciendo un total de 1 000 tilapias por estanques, la densidad de siembra fue 4 tilapias / m2. La alimentación fue en base a un producto comercial cuya dieta de alimentación fue de dos veces al día, esto fue para todos los tratamientos. Se utilizó un diseño completamente al azar, la duración del experimento fue de 120 días, los tratamientos fueron los siguientes; estanque 1 (testigo), estanque 2 (EM en el agua), estanque 3 (EM en el alimento), la alimentación fue en base a un producto comercial en el caso del estanque 3 se adicionó el producto comercial más el EM. Se evaluó el 5 % de la población del estanque que son 50 tilapias, las evaluaciones de biomasa y conversión alimenticia se hizo semanalmente, teniendo 16 evaluaciones. Los resultados fueron analizados en cada variable mediante la prueba de medias y desviación estándar, varianza. Se mejoró la calidad de agua en el estanque 1 y 2 con el uso de microorganismos eficientes, teniendo mejor parámetro en turbidez, oxígeno disuelto, ph y reducción de amonio. El aprovechamiento del recurso hídrico en los estanques 2 y 3 fue mayor la que nos brindó parámetros superiores al estanque. El uso de microorganismos eficientes (ME), redujo hasta en un 88% de microorganismos patógenos en el estanque 2 y un 53% en el estanque 3. Se aumentó el rendimiento de la conversión alimenticia con el uso de microorganismos eficaces, teniendo mejor índice en el estanque 3.
La teoría del derecho procesal surge en Alemania e Italia en la segunda mitad del siglo pasado, distinguiéndose diferentes concepciones sobre la doctrina general del proceso o del derecho procesal. En un primer momento, se postuló un sistema unitario; paulatinamente este se fue desprendiendo en sus diferentes ramas: se inició con los derechos procesal civil y penal, luego el derecho procesal administrativo, el derecho procesal laboral, y una de las más actuales es el derecho procesal constitucional. (Fix-Samudio, 1976). Según Chiovenda y Calamendrai, los tres conceptos fundamentales de la ciencia procesal son: acción, jurisdicción y proceso y ellos engloban todos los procesos.
La presente investigación tuvo como objetivo estudiar el abuso del proceso contencioso administrativo por extinción de la concesión minera en el Instituto Geológico, Minero y Metalúrgico durante el año 2019. Para ello, se optó por una investigación de enfoque cualitativo, en la que se recurrió a la teoría fundamentada, la hermenéutica y el estudio de caso para interpretar los datos obtenidos de las entrevistas a especialistas y de los procesos judiciales en materia contenciosa administrativa relacionados a derechos mineros. Asimismo, la información recopilada de las entrevistas fue analizada con ayuda del software de análisis de datos cualitativos ATLAS.ti 9, y los datos recopilados de los procesos judiciales mediante el software de análisis de datos Excel 2016. Los resultados obtenidos demostraron la existencia del abuso del proceso, por parte de los titulares de las concesiones mineras, al recurrir al proceso contencioso administrativo con la interposición de demandas carentes de fundamentos y sin expectativa de éxito, con el fin de solicitar la nulidad de la resolución administrativa que declaró la extinción de la concesión minera; así como la nulidad de la resolución administrativa que declaró la inadmisibilidad de la acreditación del pago del derecho de vigencia y/o penalidad.
