O presente trabalho, com base em pesquisas bibliográficas e documentais, busca esclarecer dogmaticamente sobre a eficácia horizontal dos direitos fundamentais durante a pandemia de covid-19. O objetivo geral é compreender como se deu a eficácia horizontal dos direitos fundamentais nas relações particulares durante o contexto pandêmico. Para tanto trabalhou-se nos objetivos específicos/conexos o contexto histórico dos direitos fundamentais, bem como o conceito dos direitos fundamentais, o contexto brasileiro dos direitos fundamentais e ainda suas principais características. Além disso houve contextualização do momento pandêmico e suas principais implicações perante à sociedade globalizada e a necessidade de observância do dever fundamental de solidariedade nos tempos da covid-19. Nesse parâmetro, todas as abordagens realizadas são para chegar na questão da eficácia horizontal que já vinha sendo debatida no meio acadêmico e, que certamente, foram intensificados durante a pandemia instigando essa pesquisa. Ao final, para enriquecer toda a discussão proposta, houve apontamentos sobre duas decisões do Supremo Tribunal Federal proferidas antes e durante o contexto pandêmico com o objetivo de demonstrar como os tribunais têm se comportado frente a esta temática. A pesquisa foi realizada com base no método dedutivo, buscando abordar primeiramente os direitos fundamentais enquanto premissa geral, para posteriormente adentrar na premissa específica de eficácia desses direitos nas relações particulares. Ao final da pesquisa a conclusão que se chegou é que os direitos fundamentais produzem eficácia nas relações privadas e a medida de tal influência deve ser a da eficácia imediata. Tal eficácia revelou-se fundamental no enfrentamento à covid-19, pois as liberdades foram restringidas em prol de um bem maior: a saúde da coletividade.
