O presente artigo científico contém resultados parciais de pesquisa etnográfica, de caráter exploratório, realizada na cidade de Petrópolis, Rio de Janeiro, tendo como objeto conflitos surgidos em escolas desse município e os mecanismos judiciais e extrajudiciais acionados para administrá-los. Apresenta o relato de algumas entrevistas realizadas e casos observados que evidenciaram uma tendência à judicialização desses conflitos como o caminho mais comum observado, ao invés das soluções consensuais, notadamente a mediação. A partir dessa constatação empírica o artigo busca identificar as razões pelas quais, a despeito de todo o movimento nacional de estímulo às soluções consensuais, muitos conflitos escolares tendem a ser judicializados, com importantes consequências para todos os envolvidos. Nessa perspectiva, apresenta um contraste entre as tradições argentina e brasileira no emprego da mediação escolar. O artigo também constata empiricamente o agravamento de conflitos escolares em espécie pela incidência da chamada espiral do conflito, recomendando a ampliação do debate sobre as formas mais adequadas para o seu tratamento, dadas as suas especificidades.
O artigo se propõe a problematizar e refletir sobre iniciativas recentes de governos estaduais e locais, no Brasil, que envolvem, em maior ou menor grau, a militarização de escolas públicas como medida destinada a coibir casos de violência nessas instituições de ensino. Combina resultado de revisão bibliográfica com informações retiradas de matérias jornalísticas e dados de campo, estes últimos provenientes de pesquisa empírica qualitativa realizada no município de Petrópolis, estado do Rio de Janeiro, Brasil. Foi possível reconhecer que, apesar do necessário respeito ao interesse, cada vez maior, de famílias por um ensino militarizado, a opção por resolver conflitos escolares dessa forma pode não ser adequada, mas pelo contrário recrudescer as animosidades, afastando a escola de seu papel principal.
Este ensaio se propõe a refletir sobre formas de lidar com algumas consequências jurídicas do isolamento social como medida de enfrentamento à pandemia de COVID-19 no Brasil. Propõe o estímulo à utilização mais ampla de formas consensuais de solução de conflitos, alternativas ou complementares ao Poder Judiciário. O diálogo, o entendimento e o emprego de métodos autocompositivos como a negociação, a mediação e a conciliação, mais do que a judicialização dos conflitos, podem proporcionar soluções adequadas para minimizar certos impactos da pandemia no campo do direito dos contratos. Do ponto de vista metodológico, o texto lançou mão de fontes bibliográficas e do relato de experiências.
