Os casos chamam atenção não apenas para a negligência do empresariado e do poder público com tais empreendimentos, mas também para a imprevidência no que diz respeito à gestão das catástrofes. Recentemente, a gestão desses desastres tem se deslocado do eixo da investigação de possíveis crimes ou infrações legais para o eixo do tratamento administrativo de "conflitos socioambientais", aos quais são dedicadas tecnologias diversas de prevenção de disputas, com ênfase em acordos orientados à construção de pretensos pactos entre partes potencialmente litigantes.No caso de Mariana, o gerenciamento da crise derivada do desastre tem implicado na mobilização de dispositivos específicos, como mesas de negociação e a assinatura do "Termo de Transação e de Ajustamento de Conduta", celebrado entre a União, os governos dos estados de Minas Gerais e Espírito Santo, e as empresas responsáveis (3). Tais dispositivos são mobilizados sob a justificativa da necessidade de uma ação mais célere e eficaz em contraste com a ênfase em punições por via da judicialização, com a responsabilização dos agentes corporativos e o cumprimento das demandas colocadas pelos atingidos.Não obstante as justificativas, esse processo de contratualização (4) se realiza, de fato, em detrimento dos espaços e possibilidades de participação dos atingidos e apoiadores, segmentos que não foram ouvidos ou consultados quando da elaboração do referido termo. Tal tratamento evidencia os limites das instituições de defesa dos direitos que, a partir de receituários oriundos de instituições financeiras internacionais para o uso de tecnologias resolutivas, circunscrevem o debate político ao ajuste de interesses entre as partes. Desse modo, sob a égide de uma harmonia coerciva (5), escamoteia-se a discussão acerca do modelo de desenvolvimento adotado, os riscos envolvidos nas atividades econômicas priorizadas e as responsabilidades dos agentes corporativos na profusão de incertezas e danos.Este artigo analisa as classificações administrativas e as ações adotadas por parte do Estado e das empresas que culminam no sofrimento social e na perpetuação de injustiças socioambientais. Sob o manto da mediação e do acordo, por vezes operam imposições excludentes, cujo efeito é a flexibilização de direitos já garantidos pela Constituição Federal. Como se discutirá, a redução das possibilidades de participação enseja não só o agravamento de vulnerabilidades desencadeadas pelo desastre, mas a marginalização das mobilizações locais dos atingidos. A ruptura de duas barragens em Minas Gerais - em Mariana (2015) e em Brumadinho (2019) - custou centenas de vidas e destruiu a maior parte das bacias do Rio Doce e do Rio Paraopeba. Esses eventos são o auge dos desastres, que começaram com o licenciamento ambiental e continuaram com uma ineficiente gestão de reparação de danos, causando ainda mais sofrimento social. Após os desastres, as instituições públicas, além de não fortalecerem o marco regulatório, aceleraram sua flexibilização. Como resultado, as empresas de mineração puderam introduzir a cultura do neocoronelismo nos sistemas de governança, ou seja, não somente fortaleceram seus interesses frente às demandas das vítimas, como também aumentaram o controle territorial das áreas afetadas pelos desastres por meio de "grilagem oculta de terras" (hidden landgrabbing).
As formas contemporâneas de inserção do país na economia-mundo resultam muitas vezes em processos conflitivos envolvendo parcelas das populações locais, do Estado e dos agentes empresariais cujos investimentos se baseiam na exploração intensiva de recursos naturais. No Vale do Jequitinhonha, Minas Gerais, os conflitos se multiplicam tendo por objeto a gestão das águas. Na literatura especializada, os conflitos sobre a água estão associados às condições distributivas, à desigualdade social e ao descompasso entre diferentes representações culturais. Nesse horizonte, este artigo examina, em particular, o conflito e os desafios vivenciados pelas comunidades ribeirinhas residentes a jusante da barragem de Irapé no que se refere às alterações provocadas em seu modo de vida a partir da instalação da usina no rio Jequitinhonha. Através da experiência como pesquisadores e assessores junto a essas comunidades, o texto discute as controvérsias sóciotécnicas e normativas envolvidas na naturalização da água como mercadoria, destacando seus efeitos na produção de um estado de insegurança e vulnerabilidade imposto à população local
Este trabalho trata das relações de poder no conselho consultivo da APA-Sul, uma unidade de conservação localizada na Região Metropolitana de Belo Horizonte. Observa-se uma sub-representação dos setores populares, e os representantes de renda média-alta temem a favelização da região. Conseqüentemente, o conflito ambiental surge em torno da perda da qualidade ambiental nas referidas áreas, em parte associada às alternativas de habitação popular, abrindo oportunidade para discursos que justifiquem a segregação social no espaço e a elitização da paisagem em questão.
