Mit den Sozialwahlen, laut Bundesministerium für Arbeit und Soziales das „Kernstück der Demokratie in der Sozialversicherung“ (BMAS 2010), wurden 2011 wieder die Verwaltungsräte der Krankenkassen aus Vertretern der Arbeitgeber und Versicherten konstituiert. Die meisten Krankenkassen nutzten dabei die Möglichkeit sogenannter Friedenswahlen, bei denen die aufgestellten Kandidatinnen und Kandidaten ohne Wahlhandlung als gewählt gelten, wenn es nicht mehr Bewerber/-innen als Mandate gibt. Der vorliegende Beitrag untersucht die Legitimation der Sozialwahlen und berücksichtigt dabei den Wahlmodus, den institutionellen Rahmen und die Präferenzen der Akteure.
