Introdução: O presente estudo busca compreender a atuação de advogados e organizações não governamentais no fenômeno da judicialização da saúde no Brasil, com base em um conjunto de ações judicias julgadas em primeira e segunda instância na Comarca de Campinas no ano de 2012. Métodos: Estudo descritivo e retrospectivo, com dados coletados por meio de entrevistas com 27 advogados, responsáveis por 78 ações judiciais. Resultados: De modo geral, os advogados cobram pelos honorários profissionais, representam clientes com elevado poder aquisitivo, solicitam os benefícios da justiça gratuita para seus clientes, mantêm relações com diversas associações sem fins lucrativos que atuam na área da saúde, exploram esse nicho de mercado e possuem uma prática voltada para a litigância. Identificou-se a atuação de duas organizações não governamentais, que mantêm relações com diversos outros atores, incluindo empresas do complexo econômico-industrial da saúde. Conclusão: Argumenta-se que a judicialização da saúde não contempla os grupos mais vulneráveis da sociedade, sendo permeada por relações duvidosas e pouco transparentes entre os atores que dela participam. Além disso, o judiciário carece de conhecimento sobre os elementos da realidade em que atua e que, agindo de forma não articulada como os outros membros do poder público, não é capaz de realmente mitigar o problema da saúde pública.
Este artigo tem como objetivo caracterizar perfis de gestão e atuação de Organizações da Sociedade Civil (OSCs) conformadas em redes voltadas para o desenvolvimento social. Trata-se de um estudo de caso que analisa, comparativamente, 20 OSCs, tomando como ponto de partida dimensões analíticas relacionadas ao planejamento e execução de atividades, direção e controle, e seleção de membros para compor a organização. O estudo identifica que a atuação das OSCs pode ser entendida a partir de dois parâmetros: (i) governança estratégica, isto é, incidência política da organização, cujo foco de atuação se dá na sensibilização e mobilização de um público-alvo para com determinada causa; e (ii) atuação de base, ou seja, a atuação das organizações na implementação de programas, projetos e/ou ações em nível de rua ou in loco. Baseando-se nesses parâmetros, propõe-se uma matriz teórico-conceitual que categoriza a atuação das OSCs em quatro perfis: Perfil Regulador; Perfil Impreciso; Perfil Híbrido; e Perfil Linha de Frente. A matriz pode servir como ferramenta para uma distribuição mais eficiente dos recursos por parte do poder público, identificando OSCs que sejam dotadas das características que darão melhor capilaridade e eficiência para prestação do serviço desejado. A capacidade de um governo de reconhecer o perfil das OSCs que atuam em seu território permite traçar arranjos que fortaleçam sua atuação. Logo, os achados estimulam reflexões teóricas e investigações empíricas que ampliam o conhecimento sobre o fenômeno, abrindo possibilidades para estudos sobre redes em perspectivas e contextos distintos.
O presente estudo busca identificar a existência de paralelos entre o deferimento do benefício da justiça gratuita e o estado de vulnerabilidade social dos beneficiários da gratuidade no que se refere às demandas judiciais em saúde pública. Trata-se de um estudo empírico e retrospectivo, com base em um conjunto de ações judicias movidas na Comarca de Campinas e que versam sobre o direito à saúde pública. Houve a comparação espacial entre o local de residência dos autores das ações estudadas e as regiões de vulnerabilidade geradas pelo Índice Paulista de Vulnerabilidade (IPVS). Conclui-se pela inexistência de vínculos entre o deferimento da gratuidade e a vulnerabilidade social dos beneficiários, indicando que o movimento da judicialização da saúde pública não se refere às camadas mais vulneráveis da população. Argumenta-se que a manutenção das estruturas socais excludentes pode ser aspecto inerente ao fenômeno da judicialização da saúde pública enquanto fenômeno jurídico-social.
ResumoO presente estudo busca identificar e analisar padrões decisórios da Justiça Civil Comum do Estado de São Paulo, em primeira e segunda instância, quanto ao fenômeno da judicialização da saúde pública, com base em um conjunto de ações judicias oriundas da Comarca de Campinas e julgadas pelo tribunal no ano de 2012. Trata-se de estudo empírico, descritivo e retrospectivo, cujos dados foram coletados por meio de consulta aos processos judiciais. Utiliza de métodos qualitativos e quantitativos de análise. Os resultados revelam determinados padrões nas causas estudadas e a ocorrência de divergências entre os padrões decisórios de primeira e segunda instância. As decisões em primeira instância, mais diversas, indicam relações com outros elementos processuais, como a patologia declarada, inclinação pessoal do magistrado, contato mais próximo com gestores públicos locais, entre outros.Palavras-chave: Divergências decisórias. This paper analyzes the phenomenon of the judicialization of public health care in Campinas starting from the analysis of a lawsuit set in the recent past. The paper describes how the civil courts of justice of first and second instance of São Paulo, with regard to lawsuits from Campinas, has manifested itself in their decisions about the access to actions and public health care services, as well the paper describes the main elements of the context of these lawsuits.After, the paper makes the analysis of the dynamics of the elements described, revealing what the case of Campinas shows about the topic of the judicialization of public health care in Brazil.
