Mit Beginn des Europäischen Binnenmarktes am 1. Januar 1993 ist in der Bundesrepublik Deutschland die Vierte Novelle des Kreditwesengesetzes (KWG) in Kraft getreten, die wichtige EG-Richtlinien in deutsches Recht transformiert und damit zu einer EG-weiten Bankrechtsharmonisierung beiträgt. Im folgenden werden insbesondere die sich aus der Zweiten Bankrechtskoordinierungs-Richtlinie und der Eigenmittel-Richtlinie ergebenden Änderungen des Kreditwesengesetzes in ihren Grundzügen dargestellt. Die Transformation der Solvabilitäts-Richtlinie in den neuen Grundsatz I wird in einem weiteren Beitrag behandelt.
Am 31. Dezember 1995 ist in der Bundesrepublik Deutschland die Fünfte Novelle des Kreditwesengesetzes (KWG) in Kraft getreten, in der die Großkredit-Richtlinie und die Konsolidierungs-Richtlinie der Europäischen Union (EU) in deutsches Recht transformiert worden sind. Zunächst werden die wesentlichen Änderungen des Kreditwesengesetzes aufgrund der Fünften KWG-Noveüe in einem Überblick dargestellt. Die Änderungen, die sich aufgrund der Fünften KWG-Novelle für die Großkreditnormen des § 13 KWG ergeben haben, werden in diesem Beitrag detailliert erläutert. Weitere wesentliche Änderungen des Kreditwesengesetzes, insbesondere der erweiterte Kreditbegriff des § 19 KWG, die Regelungen der Kreditbestimmungsverordnung und die Miüionenkreditbestimmungen sowie die Konsolidierungsvorschriften der §§10a und 13a KWG wird der Verfasser in Beiträgen in den folgenden Heften der ZBB behandeln.
Die Novellierung des Grundsatzes I ist am I.Januar 1993 zusammen mit der Vierten Novelle des Kreditwesengesetzes (KWG) in Kraft getreten. Durch die Transformation der EG-Solvabilitäts-Richtlinie in den neuen Grundsatz I ist ein weiterer wichtiger Grundstein einer europäischen Bankrechtsharmonisierung gelegt worden. Im folgenden werden die wesentlichen Neuerungen des Grundsatzes I, die sich aufgrund der Umsetzung der Solvabilitäts-Richtlinie in deutsches Recht ergeben, in ihren Grundzügen dargestellt. Die deutschen Kreditinstitute mußten ihre Grundsatz-I-Auslastung nach den neuen Vorschriften erstmals zum 30. Juni 1993 der Bankenaufsicht melden. Die entscheidenden Modifikationen des Kreditwesengesetzes im Rahmen der Vierten KWG-Novelle sind in einem vorhergehenden Beitrag des Verfassers (ZBB 1993, 266) behandelt worden.
