RESUMENSe ha discutido en la jurisprudencia sobre la naturaleza jurídica de los reglamentos de ley marco, mas el debate no debe considerarse superado, mientras en razón de sus especiales características sigan existiendo argumentos que sostienen el carácter ejecutivo o legislativo de este tipo de normas. En el presente artículo se hace un análisis jurisprudencial y doctrinal de las leyes tipo marco, pero particularmente de los decretos que las desarrollan o reglamentan. Es importante analizar quién ejerce el control judicial que se hace de estos reglamentos, esto es, el Consejo de Estado o la Corte Constitucional, y las consecuencias que esto implica, en relación con el momento en que debe aplicarse dicho control. Finalmente, se determinan las razones por las que a dichos decretos se les debe reconocer naturaleza legislativa o, al menos, ecléctica, que requieren control judicial por parte de la Corte Constitucional. El fenómeno de la constitucionalización del derecho ha entregado nuevas perspectivas a todas las áreas jurídicas, inclusive a aquellas tradicionales y exegéticas, permitiendo su expansión más allá de los viejos códigos y las anquilosadas interpretaciones. En ese sentido, el estudio y la investigación del derecho se han visto permeados por estas nuevas dinámicas constitucionales; razón por la cual, los investigadores adscritos al grupo Auditorio Constitucional de la Facultad de Ciencias Jurídicas y Políticas de la Institución Universitaria de Envigado (IUE) y sus participantes invitados comparten en esta entrega los productos de sus procesos investigativos, en los que cada uno, desde su propia especialidad, ha analizado el papel de los derechos fundamentales en el sustento del Estado social de derecho.
