El Código Orgánico Integral Penal sancionaba el aborto igual que la Corte Constitucional, mediante sentencia No.34-19-IN/21. La investigación tiene como objetivo identificar la falta de conocimiento del derecho de las mujeres víctimas de violencia a acceder a la interrupción del embrazo en el sistema de Salud Pública; para el efecto, se procede analizar fuentes documentales sobre la objeción de conciencia y la interrupción voluntaria del embarazo desarrolladas en las convenciones “Belem do Para” y la “CEDAW, planteándose como posible solución al fenómeno de urgentes reformas al Código Orgánico Integral Penal y la expedición de la Ley que permita el aborto.
Esta investigación se basa en el número de matriculados en las instituciones de educación superior de Ecuador y tiene como objetivo analizar la efectividad de las políticas educativas implementadas en el país. Esta investigación se puede clasificar como exploratoria, empírica y deductiva basándose en los objetivos determinantes. Debido a la naturaleza del procesamiento de los datos es una investigación de tipo cuantitativa, correlacional. De acuerdo al criterio de clasificación del diseño de la investigación y a la cantidad de variables es multivariada.
En el contexto de la pandemia por la presencia del COVID-19, se presentan decretos ejecutivos, acuerdos ministeriales y protocolos para el manejo de cadáveres, en los que no se contemplan los derechos de los pueblos y nacionalidades indígenas al no permitir la entrega de los cadáveres para sus honras funerarias y posterior sepelio en sus territorios ancestrales. Las actuaciones estatales, ejercida por los funcionarios de la Policía Nacional, Ministerio de Salud Pública, COE, en la aplicación de los protocolos vigentes, obstruyeron los derechos de los pueblos indígenas al reconocimiento de sus costumbres ancestrales y creencias, que en el marco de la emergencia sanitaria, que no debía restringirse de manera absoluta, debiendo haberse aplicado criterios de interculturalidad para que se realicen los rituales funerarios, con las medidas sanitarias, que tiene como objetivo la validación de sus prácticas y costumbres ancestrales.
