Tras el Acuerdo de Paz entre las FARC-EP y el Gobierno Nacional, en el campo jurídico colombiano comenzó un particular desarrollo teórico sobre el significado de “Justicia Restaurativa”. Sin embargo, encuentro que el debate presenta algunas dificultades metodológicas para aproximarse a este concepto y, con ello, en su implementación. Así, la pregunta a resolver es ¿qué tanto puede entenderse la Jurisdicción Especial para la Paz (JEP) como un modelo de Justicia Restaurativa? Atendiendo que la Justicia Restaurativa al que nos aproximamos nace de un contexto de transición dentro de un sistema judicial específico, siendo distinto a la Justicia Restaurativa que se discute en el sistema penal ordinario; por ello se hace referencia a una Justicia Restaurativa - Transicional. Luego, notamos que el concepto de Justicia Restaurativa está compuesto por varios elementos, pero, dependiendo del énfasis o de su agrupación, se pueden señalar tres grandes acepciones: (i) una desde la transformación de valores en la sociedad; (ii) una relativa a las reparaciones y sanciones restaurativas; (iii) y finalmente una relativa a los procesos restaurativos. Estas tres nos servirán como bases para aproximarnos a la JEP y evaluar qué tan “restaurativo” son sus finalidades, resultados y procedimientos y así formular problemas para futuras investigaciones.
