En los últimos años se constata la importancia de la construcción de una relación de confianza entre las partes en conflicto y la figura mediadora en los primeros compases del proceso de mediación. El presente artículo pretende poner de manifiesto las aportaciones de las vanguardias en la importancia de construir una relación de confianza, con el objetivo de responder a esta cuestión: ¿por qué las partes en conflicto confían en la figura mediadora profesional? Los resultados indican que la construcción de una relación de confianza entre las partes en conflicto y la figura mediadora constituye un ingrediente clave para explicar el éxito de la mediación. Si bien los estudios presentados se han llevado a cabo en Norteamérica, es necesario que se reproduzca en otras y diversas culturas y contextos de trabajo, con el fin de establecer la existencia de diferencias y analogías en su aplicación. The importance of constructing a relationship of trust between the parties in conflict and the mediator during the early stages of the mediation process has been verified in recent years. The aim of this article is to demonstrate the contributions of these preliminary stages to the importance of building a relationship of trust, in order to answer the question of why parties in conflict trust professional mediators. The results show that the construction of a relationship of trust between the parties in conflict and the mediators represents a key element in explaining the success of a mediation process. Although the studies presented were conducted in North America, it is necessary to reproduce them in diverse cultures and working contexts so as to establish the existence of practical similarities and differences. Many studies have empirically demonstrated the importance of trust‐building between mediators and parties to a dispute. We wrote this article in response to a call by Stephen Goldberg and Margaret Shaw for studies conducted in North America to be triangulated in other countries where mediation is taking off as an alternative tool in the resolution of disputes. Our objective was to test theories on the factors that increase trust‐building in mediation. With this in mind, the study conducted by Jean Poitras in Montreal (Canada) was triangulated in the Balearic Islands (Spain) and an analysis was made of the similarities and differences between both studies using different methods.
Las vanguardias, han afirmado que existe una relación entre el establecimiento de rapport y el éxito de la Mediación. La literatura escrita, ha definido la comprensión, empatía y confianza como elementos que conforman el rapport. El presente artículo, ha considerado la oportunidad de realizar una investigación exhaustiva sobre la empatía. Para ello, ha seleccionado como método de estudio la revisión sistemática exploratoria. Los resultados, han versado sobre el fenómeno de la empatía versus imparcialidad y el Caucus como herramienta para explorar las emociones de las partes sin percibir parcialidad en la persona mediadora. Se exponen recomendaciones y propuestas de futuro.
Different studies have demonstrated that trust‐building between mediators and disputing parties is a basic factor in the success of mediation processes. The aim of this study was to conduct an integrated analysis of mediation by taking into account the perceptions of mediators working for the Mediation Service and those of the service users over a period of one year. The obtained results show statistically significant differences in the two groups’ analyzed response patterns associated with a series of factors that predict trust‐building (the mediator's legal expertise; suggesting an alternative; sincerity; focusing on settling the dispute; the appointment of a mediator by public authorities and/or by a recognized service; focusing on the parties’ common goals; highlighting the rules of mediation; and devoting some time to talking about informal matters). The identification of these factors contributes to improved training and professional practices in the field of mediation.
