<p>Argentina es el país más demandado ante el Centro Internacional de Arreglo de Diferencias sobre Inversiones (CIADI) y uno de los que más Tratados Bilaterales de Inversión (TBI) ha firmado (58 en total, 55 vigentes). La mayoría de esas demandas fueron presentadas por empresas transnacionales (ETN) por la crisis 2001-2002 así como se refirieron a sectores económicos relacionados con recursos naturales. El 20% de dichas demandas se vinculan con el sector de agua potable y saneamiento, lo que también convierte a la Argentina en el país más demandado en el CIADI por este sector. Son casos de alta conflictividad social y en donde se evidencia el rol del Estado como regulador frente al reclamo de protección de la propiedad privada por parte de las ETN, donde resalta una asimetría jurídica que favorece la protección de las inversiones sobre el resguardo de los derechos humanos, particularmente del derecho humano al agua reconocido por la ONU en 2010. Tomando el caso argentino como testigo, esta ponencia expondrá dicha asimetría que contraviene las bases más elementales del derecho internacional, evidenciando la necesidad de revisar el régimen internacional de protección de inversiones y su adecuación a los derechos humanos en tanto obligaciones <em>erga omnes</em>.</p>
La región sudamericana es la más afectada en el mundo en materia de demandas arbitrales referentes a inversiones privadas. El foro más acudido en la materia es el CIADI, dependiente del Banco Mundial, sin embargo, no es el único. En nuestra región, se ha venido avanzando en negociaciones sobre un mecanismo de solución de controversias dentro de la Unasur. El siguiente es un trabajo centrado en algunos aspectos problemáticos del régimen de protección de inversiones y del sistema de arbitraje y su comparación con proyectos para la creación de un Centro de Solución de Controversias en Materia de Inversiones de la Unasur, actualmente en negociación.
Contextualización: Las negociaciones del Acuerdo comercial entre la Unión Europea y el Mercosur (Acuerdo Mercosur-UE) fi nalizaron el 28 de junio de 2019 y casi tres años después si entrada en vigor no ha ocurrido. Las negociaciones demoraron dos décadas y su fi nalización fue anunciada como un éxito de gestión en ambos bloques regionales, destacándose lo ambicioso de alcanzar uno de los tratados comerciales más importantes en el mundo con un potencial mercado de casi 800 millones de consumidores. Objetivo: El presente estudio tiene como objetivo analizar el posible impacto ambiental del acuerdo comercial entre la unión europea y el Mercosur. Metodología: Para el desarrollo de la investigación, la metodología utilizada en la Fase de Investigación fue la inductiva, y los resultados expresados según la base lógica inductiva. Resultado: Un análisis exhaustivo de los impactos ambientales de la liberalización comercial así como de los contenidos en cuanto al desarrollo sostenible dentro del Acuerdo plantean serias dudas acerca del logro de las metas fi jadas internacionalmente por los países miembros de ambos bloques en cuanto a sus obligaciones ambientales.
el marco de la pandemia global por el COVID-19 ha alterado la vida de miles de millones de personas, pero también ha generado uno de los mayores impactos en la historia internacional reciente en materia sanitaria, con aproximadamente 4.22 millones de personas fallecidas (Our World In Data, 26/09/2021b) y más de 206 millones de personas infectadas desde el inicio de la pandemia al 26 de septiembre de 2021 (Our World In Data, 26/09/2021a). Sin embargo, la pandemia hace relucir las condiciones que ya eran preexistentes y que reflejan la desigualdad con la que países enteros, sociedades, individuos y clases sociales pueden hacer frente a esta amenaza global. En este marco de crisis, las empresas multinacionales ya están amenazando a distintos Estados en la región y fuera de ella a entablar demandas ante organismos de arbitraje internacional a fin de reclamar la protección de sus inversiones en contra de las medidas tomadas por los diferentes gobiernos en el mundo para contener la propagación del COVID-19. La presentación versará sobre cómo el sistema de solución de controversias inversor-Estado va a ser una versión más de la crisis provocada por la pandemia global, y cómo ello profundizará la crisis quitando recursos públicos que podrían utilizarse para sostener los sistemas sanitarios y las economías nacionales, incrementando así las desigualdades en vez de ayudar a resolverlas.
<h2>El presente artículo desarrolla problemas que surgen de la fragmentación del derecho internacional y de la subjetividad estatal como única figura aplicable para la asignación de responsabilidades en materia de derechos humanos. El caso concreto es el derecho humano al agua. Se enumeran las normas que establecen que el derecho al agua potable y al saneamiento es un derecho humano reconocido y vinculante tanto en el derecho internacional positivo como por el consuetudinario. Luego se definen contradicciones normativas entre el derecho humano al agua y los tratados bilaterales de inversión (TBI) que protegen a las inversiones extranjeras de empresas multinacionales. Dichas contradicciones generan asimetrías en favor de las empresas inversionistas pero que desbalancean la relación entre derechos y obligaciones, y acarrean la posible violación del derecho humano al agua. Ante estas violaciones es necesario rever la asignación de responsabilidades en el marco internacional tanto para el Estado como para los entes privados como obligaciones incumplidas en forma concurrente, es decir una misma obligación –proveer de agua y saneamiento a las comunidades- pero por causas legales distintas. La responsabilidad es la misma, y la figura del cómplice sirve a los efectos de atribuir tal responsabilidad a todos los actores involucrados para con ello resarcir a las víctimas frente a los abusos y dar herramientas que haga progresar al derecho internacional y mejore la calidad de vida de los pueblos.</h2>
