This paper is an attempt to shed light on the causes of corruption through empirical analysis of the impact of public transparency mechanisms on the frequency of improbities in Brazilian municipalities. First, we have presented a new model of corrupt agent´s utility function to better explain the results, and then some empirical evidences in favor of the hypotheses that E-government mechanisms are negatively associated with improbities in Brazilian local government.
Resumo Este artigo descreve os programas de integridade implementados pela administração pública direta brasileira, com o objetivo de comparar suas práticas com o regime internacional anticorrupção. A pesquisa analisou 12 programas de integridade pública criados por governos federal, estadual e municipal. Cada um deles foi analisado por meio de 36 indicadores, agrupados em 9 diretrizes, de acordo com as práticas previstas no regime nacional e internacional anticorrupção. Os resultados indicam que, apesar de ainda existir um número reduzido de programas, em média 70% das práticas previstas nesses regimes são observadas ao menos parcialmente. As evidências apontam que os principais desafios para o aperfeiçoamento desses programas são a adoção de verificações prévias, a combinação adequada entre os canais de denúncia e as investigações internas, bem como a promoção de capacidades institucionais. O estudo descreve as práticas adotadas pelos programas de integridade pública por meio de um conjunto de indicadores que podem ser comparados e replicados em futuras pesquisas sobre o tema.
O artigo visa contribuir para ampliar o entendimento sobre o papel do seguro garantia na contratação de obras públicas no Brasil, destacando a contribuição do performance bond no processo de gestão dessas contratações públicas. Com esse propósito, o artigo revisa a origem da securitização, discutindo a sua relevância e aplicabilidade no setor público. Para ilustrar as vantagens econômicas desse mecanismo, foram analisados 72 contratos de obras públicas no estado da Paraíba, que evidenciam a recorrência dos problemas derivados da aditivação, como o atraso das obras, observado em todos os casos da amostra, e o aumento do custo dos projetos de, em média, 15% do valor inicialmente orçado. Os resultados indicam que a adoção de mecanismos mais adequados de securitização pode trazer benefícios significativos ao processo de contratação de obras públicas no Brasil.
This paper describes the current stage of the development of the ministries’ risk management systems, considering the demands and orientations given by the Joint Normative Instruction MP/CGU n. 01/2016 and the Public Governance Decree (Decree n. 9.203, of November 22, 2017, altered by the Decree n. 9.901, of July 8, 2019). With the intention of identifying how each ministry has been managing the risks that aim at ensuring that the goals of the public policies and the strengthening of their own governance structures will be met, this research formulated indicators that allow cases to be described, based on the recommendations of national and international standards of governance and risk management. The results show that Brazilian ministerial risk management is still incipient, due to the fragile institutionalization associated with political-administrative instability. There is still a need for institutionalizing a culture of risk management and mainly, adopting a long-term perspective in the public sector organizations so that consistent risk management systems can be effectively implemented.
This article analyzes whether the Presidential Decrees complied with better regulation standards and results are explained in the light of the legal, managerial and cultural dimensions of the Public Administration. 128 Decrees, issued between 2009 and 2018, which institutionalize public policies or government programs are evaluated. These quantitative data were combined with the information obtained from 66 interviews with top-ranked public managers and lawyers. These results evidence a reduced compliance with better regulation practices and set the hypothesis that this institutional trajectory is going to be sustained due to an observed mismatch between the current values and practices with the underlying assumptions of the better regulation reforms.
