Mit Desistance ist das "Abstandnehmen" von kriminellem Verhalten gemeint, d. h. es geht dabei um Prozesse der Beendigung einer kriminellen Karriere. Mit dem Desistance-Konzept grenzt man sich in der kriminologischen Forschung von Perspektiven ab, die unter den Stichworten "kriminelle Karriere" und "Rückfall" vor allem abweichendes Verhalten in den Fokus rücken. Durch diese bewusste Verschiebung der Aufmerksamkeit von der Frage "Wie entsteht abweichendes Verhalten?" zur Frage "Wie wird abweichendes Verhalten beendet?" erfahren die späteren Phasen einer kriminellen Karriere erhöhte Aufmerksamkeit. Auf diese Weise trägt man solchen Erkenntnissen Rechnung, denen zufolge das Ausbleiben weiterer Delinquenz nicht einfach durch eine nachlassende Bedeutung oder Wirksamkeit der Bedingungen bzw. Prozesse erklärt werden kann, die für die Entstehung und Verfestigung von Delinquenz verantwortlich gemacht werden. Stattdessen ist auch die Beendigung einer kriminellen Karriere als Prozess anzusehen, der bestimmter Voraussetzungen, Haltungen und Handlungen bedarf. Desistance ist dabei nicht nur mit aktiven Bemühungen, bewussten Entscheidungen und veränderten Handlungsweisen verbunden, sondern bedarf auch bestimmter sozialer Bedingungen, psychischer und sozialer Ressourcen sowie professioneller fachlicher Unterstützung. Es kann als Verdienst der Desistance-Forschung angesehen werden, diese voraussetzungsvollen Prozesse, ihre Bedingungen und Verläufe sichtbar zu machen. Grundsätzlich lässt sich das
In einem kritischen Beitrag setzt sich Helge Peters mit der Desistance-Forschung im Allgemeinen und mit dem entsprechenden Schwerpunktheft der Zeitschrift Soziale Probleme (2/2016) auseinander. Auf diese Kritik wird im vorliegenden Beitrag reagiert. Dabei wird verdeutlicht, dass die Desistance-Forschung an kriminalsoziologischen Traditionen anknüpft, aber auch eine notwendige Ergänzung zu traditionellen Perspektiven darstellt, da hier Bedingungen und Verläufe des Ausstiegs aus Kriminalität analysiert und kritisch reflektiert werden.
Übergänge erweisen sich in vielen Fällen als krisenhafte Momente, in welchen gesellschaftliche Anforderungen und subjektive Möglichkeiten in konkreten Situationen ausgehandelt werden müssen, was in besonderem Maße auch für den ersten Eintritt in den Arbeitsmarkt gilt. Dies ist die Ausgangslage, von welcher aus die Integrationsprozesse ehemals strafrechtlich sanktionierter Jugendlicher in die Erwerbsarbeit dargestellt werden. Grundlage dafür sind teilnarrative Interviews, welche im Rahmen einer Längsschnittstudie in der Schweiz erhoben werden konnten. Es zeigt sich dabei, dass alle interviewten Jugendlichen der Erwerbsarbeit einen hohen Stellenwert beimessen, auch wenn das Finden einer stimmigen Anstellung sich in vielen Fällen als hindernisreich erweist. Diese Passungsprozesse sind oft verbunden mit Revisionen der Wünsche und Ziele, wobei letztlich aber der Anspruch bleibt, in der Erwerbsarbeit zu verbleiben. Dieses Schaffen von Passungsverhältnissen scheint sich für die ehemals sanktionierten Jugendlichen nicht kategorisch zu unterscheiden von den Schwierigkeiten anderer, nicht strafrechtlich belangter aber anderweitig belasteter Arbeitssuchender. Der vorliegende Artikel zeigt anhand von zwei ausgewählten Fallbeispielen auf, in welcher Art und Weise Entlassene versuchen, Sinn in Erwerbsarbeit für sich herzustellen.
