I Im Rahmen einer im Jahre 1770 verkündeten gemeinsamen Kirchenordnung sahen sich die Grafen von Erbach im Odenwald in Erweiterung einer älteren Schabbathverordnung von 1704 veranlaßt, zur Separierung bestehender geschäftlicher Kontakte zwischen ihren christlichen und jüdischen Untertanen an Sonn-und Feiertagen das Folgende wörtlich zu bestimmen: 1 Weil man auch mit großem Mißfallen [hat] wahrnehmen müssen, daß an unsern christlichen Sonn-, Fest-und Feyertagen ein jeder ungescheuet in die Judenhäuser laufe und seine irdischen Angelegenheiten bey denselben verrichte, dieses aber selbst denen Juden, die auf ihre Sabbathe und durch Christi Zukunft ins Fleisch längst abolirte Mosaische Ceremonien so genau halten, zum Anstoß undÄrgerniß gereichen muß; so soll von nun anförohin kein Bürger, Untertan oder sonst jemand an Sonn-und Feyertagen bei 5 Gulden Strafe in eines Juden Haus gehen oderDieser Text stellt die vor allem durch Fußnoten erweiterte und im Text teilweise umformulierte Fassung eines am 7. Mai 1996 in der Universität Mönchen gehaltenen Vertrags dar. Er basiert seinerseits teilweise auf einem am 28. Januar 1994 im Rahmen eines Kolloquiums zur Migrationsforschung an der Universität Stuttgart gehaltenen Vortrag über "Grenzen und Möglichkeiten der Integration von Juden in der Gesellschaft des Anden Rogime", der als Bd, 3 der "Stuttgarter Beiträge zur Historischen Integrationsforschung" (hg. von MARTIN KINZINGER) veröffentlicht werden wird. Für

Nicht in dieser stehen E 3 -E 10; als völliges Ineditum erscheint nur E 9, die "rubrikenähnliche Zusammenfassung der vielleicht im Oktober 1246 entstandenen [und überschriftslos edierten] Konstitution I 66.2" unter dem Zwischentitel "Daß der Baiulus keine Strafe erlassen darf' (Ut baiulus nullam penam dimittat). E 9 besteht dann aus nur noch einem Satz und wird ebenfalls "Friedrich II., vielleicht Oktober 1246", zugeschrieben 33 ).Dadurch bereitet der Editor Verständnisschwierigkeiten. Da in der zugrundeliegenden Madrider "Papierhandschrift des 15. Jahrhunderts" (Ma) E 9 als Schluß der hiesigen -unteritalienisch-sizilischen -Novellensammlung überliefert ist, während I 66.2 mit eigener Überschrift [!] "Wofür die Baiuli-Ämter zuständig sind" (Que pertinent ad officia baiulorum) in deren Mitte steht, ist es schwierig, E 9 nur als jene "rubrikenähnliche Zusammenfassung" zurückzustellen: Und die unmittelbar vorangehenden Gesetze I 95.1-3 "zur Anzahl und Amtsdauer der Amtsträger" {De numero officialium, et infra quod tempus eorum administratio duret) erscheinen in Ma gar überschriftslos und in einem Stück mit separater Veröffentlichungsanweisung 34 ). Berücksichtigt man schließlich auch die doppelte Schlußformel in Ma nach E 9, wonach hier Kaiser Friedrichs II. Novellensammlung [!] zuende ist und auch das Schreibwerk zu Christi Ruhm schließt (Expliciunt constituciones novelle, quas imperator Fridericus semper augustus conpilavit [!]. Finis adest operi -gloria Christe tibi!), so wird tatsächlich die Existenz von E 9 als Gesetz suggeriert. Dies aber gleichzeitig mit I 66.2 zu datieren, in dem dieselbe Materie ausführlicher und differenzierter geregelt und auch die Haftbarkeit der Baiuli fixiert wird, bereitet Schwierigkeiten. Am ehesten ist E 9 als Gesetz zu verstehen, das durch die detaillierte Regelung von I 66.2 ersetzt wurde, so daß die Überlieferung von E 9 abbrach und nur noch gleichsam zufällig ins 15. Jahrhundert hinabreicht: aufgelesen von einem Novellensammler, der den Gesamtüberblick über den Stoff nicht mehr wahrte. All diese Überlegungen lassen sich jetzt an Hand und mit Hilfe der kritischen Gesetze-Edition fundierter anstellen. Insgesamt liegt eine Forschungs-und Editionsleistung vor, die der Weiterbeschäftigung mit Kaiser Friedrich II. und seiner Zeit Auftrieb gibt und dem Rechtshistoriker solide Materialgrundlagen liefert.
