Este estudo objetiva responder: quais os meios de prova usados em casos criminais de insider trading nos Estados Unidos da América (EUA)?; Há a possibilidade desses meios de prova serem aplicados nas ações penais brasileiras sobre o tema?. Estabelece-se o conceito do uso de informações privilegiadas em sua faceta criminal pela exposição das controvérsias na temática e de como esta é tratada na literatura nacional e internacional, por constituir um estudo comparado. Depois, aborda-se a Metodologia de Análise de Decisões como forma de investigação empírica, para que se discuta a atividade probatória nos crimes de insider trading. Discute-se como os EUA enfrentam o assunto, especialmente, quanto ao papel das provas, para trazer elementos para o aplicador da lei brasileira. A abordagem é qualitativa e quantitativa, com revisão de literatura e Metodologias de Análise de Conteúdo e Análise de Decisões. A unidade de análise são casos criminais estadunidenses, em 2019. Concluem-se como meios de prova usados nestes: quebra de sigilo telefônico; confissão; testemunhos; prova emprestada; comunicação com sindicatos; análise estatística; artigos de jornais e conclusões do Comitê de Auditoria da própria empresa. São provas, plenamente, possíveis de levantamento e construção pelo Judiciário criminal brasileiro, então, apresentam-se propostas de melhoria.
A proposta da pesquisa é investigar quem são os indiciados e efetivamente condenados ou absolvidos, em matéria de infração por prática de insider trading, no âmbito da Comissão de Valores Mobiliários (CVM) em Processos Administrativos Sancionadores (PAS). A partir de uma perspectiva empírica, utilizando a Metodologia de Análise de Decisões (MAD), dentro do recorte temporal com início no ano de 2004 até o ano 2019, a pesquisa procurou delimitar qual o perfil das pessoas físicas condenadas pela prática, ou seja, se mantinham, ou não, relação com a companhia. Outras variáveis na linha investigativa foram: quais os cargos que sofreram mais condenações, e quais foram as penas aplicadas. Como resultado, a pesquisa verificou que a maioria das condenações foram aplicadas aos membros internos das companhias, e quase a totalidade das penalidades foram na modalidade multa, confirmando a hipótese inicial
Esta pesquisa tem como objetivo responder ao seguinte questionamento: qual o índice de reforma, em sede de apelação, nas Câmaras criminais do Tribunal de Justiça do Estado do Ceará, das sentenças de 1º Grau em crimes tributários? Para tanto, é necessário atender a quatro objetivos específicos: 1) estabelecer o lugar conceitual do de crimes tributários, dentro do contexto do Direito Penal Econômico; 2) investigar e demonstrar a Metodologia de análise de decisões como forma de investigação empírica e necessária, delineando quais as teses mais recorrentes pelas defesas e acusações, quais os dados apresentados por estas; quais os dados levados em consideração pelo julgador; quais as proxys dos índices de provimento dos recursos; 4) apresentar, de modo empírico, aplicando a Análise de Conteúdo os resultados da pesquisa, a partir da esquematização sobre com que resultados? com que finalidade? de que modo? A quem? para dizer o que? A abordagem é qualitativa e quantitativa, com base em revisão de literatura e aplicação da Metodologia de Análise de Conteúdo e Análise de Decisões. A unidade de análise é o Tribunal de Justiça do Estado do Ceará, e a periodização entre 2016 e 2021. Conclui-se que a tendência decisional da Corte encaixa-se na proxy 1, estando entre 1 e 7 para provimento, da análise dos 27 acórdãos.
Esta pesquisa tem como objetivo responder ao seguinte questionamento: qual é a principal diferença entre processos administrativos sancionadores (PAS) da Comissão de Valores Mobiliários (CVM) que julgam insiders primários e secundários? Para tanto, é necessário atender a quatro objetivos específicos: 1) estabelecer o lugar conceitual do uso de informações privilegiadas; e quem pode ser considerado um insider primário ou secundário; 2) analisar o papel da Comissão de Valores Mobiliários nos Processos Sancionadores; 3) investigar e demonstrar a metodologia da análise de conteúdo como forma de investigação empírica e necessária, bem como a utilização do Iramuteq em estudos jurídicos; 4) apresentar, de modo empírico, se houve diferença entre o conteúdo decisório nas condenações dos insiders primários e secundários, por meio da aplicação da Metodologia de Análise de Decisões (MAD). A abordagem é qualitativa, com base em revisão de literatura e aplicação da Metodologia de Análise de Conteúdo e Análise de Decisões, auxiliada por análise estatística com o software Iramuteq, do studio R. A unidade de análise é Comissão de Valores Mobiliários, e a periodização entre 2017 e 2021. Conclui-se que a maior diferença entre o conteúdo dos votos é a presunção sobre a relevância da informação para o primário, que inexiste para o secundário.
Esta pesquisa tem como objetivo responder ao seguinte questionamento: de que maneira é tratado ogarante penal nos julgados do STF sobre responsabilidade por omissão em casos de crimes ambientais? Para tanto, é necessário atender a três objetivos específicos: estabelecer o lugar da responsabilidade por omissão em crimes ambientais no âmbito do processo penal, expor o conceito de garante e verificar se há critérios para sua identificação e discussão prática, por meio da aplicação da Metodologia de Análise de Decisões (MAD). A abordagem é qualitativa, com base em revisão de literatura e aplicação da Metodologia de Análise de Decisões, auxiliada por análise estatística com o software Iramuteq, do studio R. A unidade de análise é o Supremo Tribunal Federal, e a periodização entre 1998 e 2021. Conclui-se que inexistem discussões sobre quem poderia ser o garante ou, detentor da culpabilidade nos crimes omissivos ambientais, não existindo critérios objetivos para a sua caracterização. Como consequência é possível que decisões judiciais fundadas em culpabilidade sejam incompatíveis com a literatura penal e ineficientes para a proteção ao meio ambiente.
