Abstrak: Pemilihan umum merupakan isntrumen penting dalam negara demokrasi dengan sistem perwakilan, perkembangan pemilihan umum dalam konsep demokrasi Indonesia membawa threshold pada setiap sistem bentuk pemilihan umum, mulai dari electoral treshold sebagai syarat partai politik dapat ikut serta dalam Pemilu, parliamentary treshold sebagai bentuk ambang batas partai untuk menduduki kursi parlemen pusat, sehingga presidential treshold sebagai ambang batas suara partai untuk mengusung calon presiden dan wakil presiden dalam pemilihan, lahirnya aturan ambang batas diwarnai dengan berbagai polemik di masyarakat yang menanggapi secara pro dan kontra terkait aturan tersebut perdebatan panjang dalam menentukan ambang batas pencalonan presiden dan wakil presiden terjadi cukup alot pada saat pembahasan Rancangan RUU Pemilu, pemilihan umum diselenggarakan sebagai pengakuan atas hak setiap warga negara dijamin dalam konstitusi. Partisipasi rakyat dalam politik merupakan salah satu syarat sosial yang urgent dari pemerintahan yang demokratis. Sebab kedaulatan rakyat dalam sistem demokrasi tercermin dalam ungkapan sistem pemerintahan dari rakyat oleh rakyat dan untuk rakyat, “government of the people by the people for the people”, dengan tujuan utama memberikan kebahagiaan yang sebesar-sebesarnya kepada rakyat. Sehingga threshold berpotensi menimbulkan pelanggaran hak konstitusional warga negara yang dijamin konstitusi.

Therefore, the revocation of the right to vote and be elected (participation in the General Election) is the implementation of an extraordinary enforcement of criminal law. The legal classification is that it is permissible for ex-corruptors to become legislative candidates if viewed from the level of their need is al-Hajiyat but based on its scope it is of special interest (al-Maslahah al-Khossoh) which is oriented to the benefit of the corruptors whose political rights are taken away, while what needs to be underlined is the rights of the wider community. who are deprived of their social and economic rights so as to further distance them from justice and welfare as the main core of the purpose of the law itself.
