The article discusses the impact of the pandemic COVID-19 on the human rights, in particular, the right to freedom of movement and free choice of residence. The purpose of the article is to investigate whether the restrictions implemented to prevent spread of the infection were legitimate and necessary. The concept and content of the right to free movement according to Ukrainian legislation has been investigated. The legitimate grounds for restriction of human rights were analyzed. The state of compliance of Ukrainian legislation with the legislation of the EU and world standards was revealed. The range of issues that Ukraine faced during the pandemic COVID-19 and limitations of human rights were disclosed. Particular attention was paid to legal acts which implemented such limitations. It was revealed that the approach of the Ukrainian legislator while implementing restrictions of human rights was unconstitutional and violated fundamental human freedoms. General and special scientific methods were used in the process of research, such as dialectical, comparative, dogmatic and legal methods.
Мета статті полягає у виробленні пропозицій щодо удосконалення контролю за повітряним простором як елементу забезпечення прикордонної безпеки. Методи дослідження: застосування системно-структурного методу і методу узагальнень дозволило виявити загальні тенденції застосування літальних апаратів у прикордонному повітряному просторі з незаконною метою і встановити пов'язані з цим правові проблеми. В результаті застосування формально-юридичного методу запропоновані шляхи вдосконалення законодавства. Результати: як результат наукового пошуку запропоновані напрями нормативно-правового регулювання у сфері контролю за повітряним простором у діяльності Державної прикордонної служби України. Обговорення: повноваження контролю за повітряним простором над смугою земної поверхні, що проходить уздовж державного кордону, покладені на Збройні Сили України. Водночас, у сучасних умовах у прикордонному просторі поширене протиправне використання літальних апаратів, які за особливостями конструкції та вагою не завжди можуть бути виявлені силами ППО ЗС України. Основна увага у статті зосереджена на аналізі досвіду з охорони державного кордону України, який демонструє, що фактично протидіють протиправному застосуванню літальних апаратів у прикордонному просторі підрозділи прикоронної служби. Сформульовані пропозиції щодо правового забезпечення контролю повітряного простору як елементу забезпечення прикордонної безпеки. Законом України «Про державний кордон України» визначено, що охорона державного кордону України на суші, морі, річках, озерах та інших водоймах покладається на Державну прикордонну службу України (ДПСУ), а у повітряному та підводному просторі -на Збройні Сили України (ЗСУ). Крім того, відповідно до Повітряного кодексу України контроль за дотриманням порядку використання повітряного простору України під час охорони державного кордону України, контроль польотів повітряних суден, що перетинають державний кордон України або виконують польоти в межах зон з ПОВІТРЯНЕ, КОСМІЧНЕ, ЕКОЛОГІЧНЕ ПРАВО
Мета: дослідити особливості інформаційного забезпечення у повітряних пунктах пропуску через державний кордон України. Методи дослідження: діалектичний, структурно-функціональний, порівняльний та ін. Результати: визначено особливості інформаційного забезпечення у пунктах пропуску повітряного сполучення, запропоновані шляхи удосконалення інформаційного забезпечення. Обговорення: з’ясовано змістовне наповнення інформаційного забезпечення, визначено основи інформаційного забезпечення тощо.
