The present study is initiated by the proliferation of a very broad authority of Regional Government in forming Regional Regulation that is not in line with the synchronization and harmonization function of optimal legislation. Each party has a strong argument in maintaining a regulation on religion. As a result, it contributes to a multi-interpreted, conflicted, and disobedient legal situation to the law that finally creates disharmony between one rule and another. A normative legal research is the type of the present study. It accentuates a literature study with the focus on the study of the principles of law, systematic system of law, legal study and legal history. A descriptive research is also included in the present research. The conclusion that can be seen from the present is that, first, decentralization of tourism management after the Constitutional Court Decision Number 137/PUU-XIII/2015 gives an authority to Regional governments in legal products making with a very broad extent. The present study expects a change in the substance of Regional Regulation of West Nusa Tenggara Province Number 2, 2016 concerning Halal Tourism and it is hoped that Regional Government of the Regencies/Cities in West Nusa Tenggara Province will immediately issue the Regional Regulations so that the maximum contribution of tourism to Regional Ownsource Revenue in sports and leisure venue levies sectors can be achieved.
This study is aimed to analyse various Indonesian national regulations that govern about the implementation of social and environmental responsibility (SER) in the actualisation of its objectives for the equitable distribution of natural resources in Indonesia. The analysis is undertaken in terms of the phrases used, the subjects who are obliged to perform SER, the funding sources, the allocation of the funds, the instructed programs, as well as the course of the SER itself. By using normative legal research, this study concludes that the existing regulations have not consistently governed the implementation and standards of SER as expected by the Government. Additionally, according to Fuller, this kind of multi-interpretation will result in the malfunction of legal products, and ultimately frustrate the achievement of the SER objectives. On this matter, it is proposed that the Indonesian government needs to formulate a regulation that comprehensively and specifically govern about the SER to become a guideline for all the existing stakeholders.
This study brought up an issue related to the ineffectiveness of the presidential threshold arrangement in Law Number 7 of 2017 on General Election that is correlated with the implementation of simultaneous general election. This was a normative legal study with statute, historical and conceptual approaches. In addition, research sources were needed to solve legal issues and to make recommendations. The sources used in this study included primary and secondary legal materials. The findings showed that the enactment of Law Number 7 of 2017 on General Election is considered ineffective because it has legal issues, such as being contradictory to the amendment of the 1945 Constitution, creating injustice for new political parties that participate in the general election, and weakening the Indonesia's presidential system.
The purpose of this study is to find out why forest management through the development policy of the Forest Management Unit (FMU) in Indonesia is needed and what are challenges of developing a Forest Management Unit in Indonesia. This study is normative legal research with primary and secondary legal materials. The results showed that the development policy of the Forest Management Unit (FMU) is needed for the benefit of the community in optimizing the management and utilization of potential funding for climate management of the regional forestry sector either at the provincial, district/city level or management unit level as well. While challenges in developing Forest Management Unit (FMU) in Indonesia including limited human resources (HR), not enough support by local governments, disharmony relationships, social conflicts, and economic interests.
