This chapter examines how the colonial legacy of racialized social stratification in Brazil affects processes of criminalization of black and indigenous populations. To this end, the chapter reflects on the history and the role of Brazilian sociopolitical institutions with regards to the social control of subaltern populations, with an emphasis on the transformations that occurred after the formal abolition of slavery and the adoption of republicanism, in the late nineteenth century. Then, through two examples, the chapter illustrates how structural racism engenders contemporary punitive practices specifically targeting indigenous and black populations. It demonstrates how criminal law provided an authoritarian inclusion of indigenous people within broader society, by means of the application of punishments that disregard their ethnic and cultural characteristics, against the special legislation in place at the time. On the other hand, the chapter observes how Brazilian policing developed in a racially selective manner, which contributes to the recrudescence of the treatment of black people and aggravates the problems of police lethality and mass incarceration, which disproportionately affect this segment of the population. The chapter concludes that the foundation of penal practices upon a colonial rationality favours the naturalization of the subalternity of Brazilian black and indigenous peoples.
O presente trabalho se propôs a investigar as estratégias utilizadas para o enfrentamento da escravidão no campo jurídico, enfocando o período compreendido entre os anos de 1860 e 1888. Também teve como meta averiguar se houve um fenômeno relevante de contestação judicial à escravidão, nos fóruns do Estado de Alagoas, recortando-se dentre as ações cíveis que tramitaram no judiciário alagoano aquelas que se referiam especificamente à questão do direito à liberdade dos escravos. Para tanto, utilizou-se a metodologia empírica, consistente na coleta e análise de dados oriundos de fontes históricas documentais – processos judiciais e demais documentos pertinentes ao tema – encontradas nos arquivos públicos e judiciários do estado de Alagoas. Ademais, para o embasamento teórico necessário à pesquisa, realizou-se investigação bibliográfica exploratória acerca da condição do negro cativo nesse período histórico e sobre a escravidão em Alagoas.
O presente artigo tem como objetivo principal analisar criticamente práticas judiciárias emblemáticas no campo criminal e o seu papel na construção das verdadesque interessam à vigente persecução penal brasileira. Importa-nos discutir, por exemplo, se a exposição de pessoas presas e a busca pela confissão são instrumentos legítimos de um sistema que se anuncia como acusatório. O recorte dessa problemática, tão importante quanto complexa, será estruturado a partir de Michel Foucault, autor cujas escavaçõesconceituais nos permitem observar mais nitidamente as articulações realizadas pelo sistema oficial de controle rumo à manutenção de seu acentuado protagonismo no exercício do poder punitivo. As hipóteses utilizadas no desenvolvimento estão baseadas na ideia de que as midiáticas apresentações de pessoas presas e a busca pela confissão do investigado são elementos fundamentais nesse processo histórico de circularidade autoritária, mantendo-se atualmente circunstâncias absolutamente desrespeitosas de direitos e garantias constitucional e democraticamente estabelecidas.
This paper aims to highlight the metaphorical nature of the criminal law discourse, by means of a critical analysis of the rationality claim in the field of law. For this purpose, metaphorology and theory of nonconceptuality are used as heuristic devices for the historicizing of legal concepts, identifying their not racionalizable elements consistent in absolute metaphors. Finally, the work exemplifies the usefulness of these theoretical precepts, from the unveiling of concepts derived from absolute metaphors of free will and determinism, in criminal speech.
OBJETIVO: Por meio deste artigo propõe-se uma reflexão/análise acerca da responsabilidade civil médica por prescrições off label em tempos de pandemia com enfoque na doença COVID-19. MÉTODO: Sob a vertente metodológica jurídico-dogmática, utilizou-se de revisão bibliográfica para a construção deste trabalho, com a análise de artigos e de doutrina nacional sobre tema, mediante a utilização do método hipotético-indutivo. RELEVÂNCIA/ORIGINALIDADE: Com o surgimento dessa e a utilização em massa dos usos off label de medicamentos, diversas contendas jurídicas poderão emergir da relação médico/paciente, de forma que o presente estudo busca compreender como se dá a prescrição off label no território brasileiro, analisar os parâmetros para usos off label lícitos em tempos comuns e discorrer sobre como a prescrição off label deve ser analisada em tempos de pandemia, identificando requisitos que autorizariam tal prática. RESULTADOS: Por conseguinte, entende-se que o profissional médico que observar certos parâmetros razoáveis para prescrição off label de medicamentos durante a pandemia COVID-19 não deve sofrer as consequências de uma responsabilização civil, devendo, no entanto, serem feitas análises cauísticas para aferição da culpa médica. CONTRIBUIÇÕES TEÓRICAS/METODOLÓGICAS: Em tempos comuns, o rigor para os usos off label deve ser diverso do aplicado em tempos de pandemia.
