Dat geldt niet alleen voor de spraakmakende zaken, maar in toenemende mate ook voor het instituut en de individuele rechter zelf. Tegelijkertijd is 'de' rechter 'ongekend'. In tegenstelling tot de andere juridische professionals in de rechtszaal, zoals het om en de advocatuur, spreekt de rechter voornamelijk door zijn vonnis en is hij of zij weinig in het publieke debat aan te treffen. De zwarte toga is zelfs een beetje een black box. Deze houding is echter niet altijd meer een overtuigende, noch voor de buitenwereld, noch voor veel rechters zelf. Er is, zowel binnen als buiten de rechtszaal, een roep om transparantie, in de zin van moderne varianten van de klassieke rechterlijke openbaarheid. De noodzaak en wil om naar nieuwe vormen van transparantie te zoeken moet echter worden afgewogen tegen de kernwaarden van de rechtspraak.
