The issue of the continental shelf delimitation on the Aegean Sea is one of the disputes pending between Turkey and Greece. This problem, which has gained visibility especially since the 70s, has become a purely political and diplomatic problem with the 1978 decision of the International Court of Justice, following the unilateral application of Greece. On the other hand, it is seen that many states have similar limitation problems and try to resolve them through the Court or different international judicial bodies. As a result, a serious accumulation of jurisprudence (case-law) has emerged on the issue of the delimitation of maritime areas by the judicial bodies. The predominant principle in the law of delimitation of maritime areas is that the delimitation should be done in a way that provides an equitable solution. This idea was also included in the 1982 United Nations Convention on the Law of the Sea. In this respect, since it would not be fair to make a delimitation based on an equidistance line to be drawn between the easternmost Greek islands and the Turkish mainland, it can be expected that a decision in this direction will not be made by the judicial organs. On the other hand, the view put forth by this study is that although it is thought that the decision of the Court may bring a result in favor of the Turkish theses in the light of case law, it should be known that once this decision is made, there will be no turning back and that the efforts to resolve this conflict through diplomacy and agreement which is the primary procedure in the 1982 Convention, should continue.
Uluslararası teamül hukuku kurallarının nasıl tespit edileceği, uluslararası teamül hukukunun en karmaşık konularından biridir. Uluslararası teamül hukuku kurallarının yazısız hukuk kuralları olması, bu kuralların varlığının ve zaman içerisinde geçirdikleri değişimin tespitini önemli hâle getirmektedir. Ancak, uluslararası teamül hukuku kurallarının maksatlı bir kanun yapma sürecinin ürünü olmaması ve kendiliğinden gelişmesi bu kuralların tespitini zorlaştırmaktadır. Mevcut hukuk kurallarını araştıran uluslararası mahkeme kararları ve bu kararlara doktrinde yöneltilen eleştiriler, somut vakaları ele almaları sebebiyle, meselenin aydınlatılmasına önemli katkılar sunmaktadır. Uluslararası mahkeme kararları ve doktrin incelendiğinde, devletlerin uluslararası nitelikteki eylem ve işlemlerinin, iç hukuk işlemlerinin, uluslararası örgütlerin kararlarının, uluslararası andlaşmaların uluslararası teamül hukuku kurallarının tespitinde doğrudan başvurulabilecek araçlar olduğu, uluslararası mahkeme kararlarının ise söz konusu kuralların saptanmasında dolaylı bir rolü olduğu sonucuna varılmıştır. Metodoloji yönünden yapılan değerlendirme neticesinde ise, uluslararası teamül hukuk kurallarının, yalnızca tümevarım metodu ile değil, tümdengelim metodu kullanılarak da tespit edilebileceği düşünülmektedir.
ÖZ1990'larda uluslararası ilişkilerde ortaya çıkışıyla beraber insan güvenliği kavramı akademik ve siyasi çevrelerde büyük ilgi uyandırmıştır. Çeşitli teoriler ortaya atılmış ve bu kavrama somut şekil verilmiştir. Bu tartışma hala devam etmektedir çünkü insanın güvensizliği dünyanın herhangi bir yerinde günlük bir deneyim olmaktan hala çıkmadı, bu da teori ile gerçeklik arasında belirli bir boşluğa işaret edebilir. Bu makale, insan güvenliğinin anlaşılmasına ve bunun siyasi topluma ilişkin memnuniyetinin genel anlamına bir katkı sağlamayı amaçlamaktadır. Kesin olarak, özcü bir bakış açısıyla, kendisini bir doğa kanunu olarak sunduğu natüralist bir insan güvenliği anlayışı ileri sürmektedir. Dolayısıyla insan güvenliği, kaçınılmaz olarak korumayı içeren doğal insan düzenini somutlaştırmaktadır. Bu doğal gereksinimi karşılama ihtiyacıyla, insan güvenliği, siyasal toplumun (doğal) kanun, yani siyasal toplumun nihai nedeni veya temeli ve amacı olarak sunulmaktadır. Böylelikle, insan güvenliğinin natüralist anlayışı, insanın politik hayvansallığının ve sözleşmesel felsefelerin yeni okumalarının temelidir.
The present article titled Organization of Turkic States as an International Organization in terms of International Law aims to assess the Organization of Turkic States which is an umbrella Organization for Turkic States that was established in 2009 with the name of Organization of Turkic Language Speaking Countries. The assessment is carried out by analysing whether the Organization of Turkic States is an international organization in terms of international law. Therefore, the analysis was conducted through discussing the organizational structure of the Organization of Turkic States, as well as competences and missions of the organs and their working principles.
