No século XIX, a literatura infantil surge como um instrumento ideológico a serviço das classes dominantes, com a finalidade de formar indivíduos alinhados com as aspirações daquelas sociedades. Esse modelo é identificado pela construção de um conhecimento bivalente e empobrecido, por limitar-se a um pensamento polarizado que se opõe à revolução filosófica ocasionada pelo giro ontológico-linguístico. Na atualidade, ainda é possível identificar essas influências em bandeiras como, por exemplo, a da “escola sem partido”, o que conduz à discussão sobre a influência da literatura infantil no ensino universitário do direito e na formação do senso comum teórico dos juristas. A partir dessa problemática, por meio do método hipotético-dedutivo, o presente ensaio propõe uma pedagogia irônica, amparada na filosofia de Rorty, como uma poderosa e emancipatória ferramenta de ensino.
Este artigo discute o papel do autor, a partir das formulações de teóricos da literatura, adota a hermenêutica filosófica como matriz teórica e tem como objetivo contribuir para o debate teórico-metodológico que envolve as pesquisas e estudos em Direito e Literatura. Para tanto, são oferecidos postulados teóricos que, relativos ao papel do autor, foram desenvolvidos pelas principais correntes da crítica literária moderna, culminando com a ideia da morte do autor e a discussão dela decorrente. A seguir, abordam-se a noção de círculo hermenêutico e sua relação com o percurso analítico-interpretativo que articula autor, texto e leitor na interpretação de narrativas literárias. Por fim, busca-se demonstrar – através do romance “1984”, de George Orwell – em que medida o contexto histórico do autor pode colaborar para a atribuição de sentido ao texto.
O presente artigo, de viés interdisciplinar, tem como objetivo examinar os modos de incorporação da literatura aos estudos historiográfi cos do direito, particularmente no que diz respeito à esfera do direito constitucional. Partindo do pressuposto de que história e direito sempre estiveram próximos – embora tal proximidade não seja comumente reconhecida –, defende-se que a interlocução da historiografi a do direito com a literatura constitui uma via imprescindível para superar impasses e avançar na construção de uma cultura constitucional adequada à modernidade tardia brasileira. Para tanto, são examinadas, mediante pesquisa bibliográfi ca, as intersecções entre história e literatura, bem como entre direito e literatura, com ênfase na posição-limite que a literatura ocupa no âmbito da hermenêutica filosófica, marco teórico que viabiliza o diálogo das três disciplinas, possibilitando à triangulação história-direito-literatura contribuir para a renovação da história constitucional e, consequentemente, para a construção de uma cultura constitucional no Brasil. Conclui-se identifi cando três eixos de estudo a partir da triangulação proposta, os quais se caracterizam: (1) pelo emprego de conceitos e de metodologias oriundas da teoria literária no exame dos textos de história do direito, abordando seu caráter inexoravelmente narrativo; (2) pela proposta de reformulação da metáfora da integridade do direito como romance histórico em cadeia, que favoreceria sua aplicação no contexto da civil law; e (3) pela abordagem da história constitucional por meio de narrativas literárias, em contraposição ao levantamento e à análise apenas de textos especifi camente jurídicos.
Objetiva-se analisar a relação existente entre o novo perfil do Ministério Público, inaugurado após a Constituição Federal de 1988, com o princípio da supremacia do interesse público, diretriz fundamental da função administrativa, enfocando especialmente nos instrumentos que o Ministério Público possui para o controle da Administração Pública.
