L'elaborato si propone di offrire un contributo all'individuazione degli strumenti di risoluzione dei conflitti familiari alternativi al processo ovvero integrativi e com¬plementari del processo. Ci si è posti l'obiettivo di dare uno sguardo al tessuto normativo previgente la riforma del processo civile, introdotta dalla legge 26 novembre 2021, n. 206, e dai decreti attuativi, in particolare dal decreto legislativo 10 ottobre 2022, n. 149, nel tentativo di cogliere e tracciare l'evoluzione sociale e giuridica degli strumenti di riorganizzazione guidata delle relazioni familiari in crisi. La mediazione familiare, la coordinazione genitoriale e la negoziazione assistita sono esaminate in un percorso funzionale di lettura nell'ambito dei principi e delle novità introdotte dalla riforma processuale Cartabia.
The urban scenarios outlined by the environmental and economic crisis have fostered, on one hand, the unstoppable gentrification of the most central neighborhoods of the cities; and on the other hand, a growing associationism committed to cultural and environmental values, which demands tools from academia to negotiate with the administration. An emblematic case is that of Arganzuela, one of the three districts of the Spanish capital affected by the rise and fall of industrialization (the freight railway in 1861 and the M-30 ring road in 1970). The burying of these infrastructures began in 1990 with the Green Railway Corridor (PVF) operation, a year after the inauguration in Paris of the Promenade Plantée on the disused railway lands, which allows us to foreshadow new scenarios. The TRAHERE project researches the state of abandonment and disaffection of the public spaces of the PVF using social networks as a connection platform with participatory channels to promote its regeneration. The challenge is to convert the concept of transfer of results into a more inclusive one of knowledge exchange, which implies a methodological change in research, with an integrating perspective that combines urban historical studies with artistic practices of production and postproduction for the dissemination of content on the networks.
This paper is focused in the contribution of the Grupo de investigación de Paisaje Cultural (GIPC/UPM) (Research Group on Cultural Landscapes) to the PATRACT project. In this framework it has been designed an integrated methodology to identify and solve physical barriers in all the scales of heritage; and in the selection, management and adaptation of information to improve the understanding the importance of heritage. This contribution is supported in a starting theory premise: the importance of continuity in the scales of accessibility to heritage, and the specificity of the relationship between the individual with the element or heritage environment. In the conclusions the GIPC group has strengthened the importance of the intermediate spaces which interlink different scales, using the quality of the design to accomplish specific solutions, and the relation between the human being and heritage as a pivotal point in the orientation and identification processes. ResumenEl presente artículo se centra en la aportación del Grupo de Investigación Paisaje Cultural (GIPC/UPM) en el proyecto de investigación PATRAC Patrimonio Accesible: I+D+i para una cultura sin barreras. En el marco de dos subproyectos, se ha trabajado, respectivamente, en el desarrollo de una metodología integrada de identificación y solución de barreras de accesibilidad física a todas las escalas del patrimonio, y en la selección, adaptación y gestión de la información de apoyo a la comprensión del bien patrimonial. El desarrollo se basa en una postura teórica previa: la importancia de la continuidad entre las escalas en la accesibilidad al patrimonio, y la especificidad de la relación entre el individuo y el elemento o entorno patrimonial. Las conclusiones recogen los conceptos que singularizan la aportación del GIPC. Así, se destaca el trabajo en aquellos espacios intermedios que conectan las diferentes escalas a las que se apunta, la calidad del diseño como medio de aplicación de criterios universales para soluciones específicas y la importancia, en la relación entre el hombre y el patrimonio, de la orientación y la identificación. La investigación que se presenta indaga acerca del valor del patrimonio industrial en la construcción del paisaje cotidiano a través del estudio del espacio público generado por la Operación Pasillo Verde Ferroviario (P.V.F.) de Madrid, en la antiguamente llamada “línea de contorno”, hace ahora aproximadamente 30 años. El análisis llevado a cabo a través de la búsqueda documental en archivos, la cartografía histórica, las ortofotos y el planeamiento nos ha permitido elaborar un inventario y un atlas del patrimonio arquitectónico, con uso y reúso de lo existente, que demuestra que el balance entre generación de espacios públicos y defensa y cuidado del patrimonio industrial no está en absoluto equilibrado. El soterramiento del trazado ferroviario supuso la oportunidad para la regeneración de una porción de ciudad que afecta a tres distritos (Moncloa-Aravaca, Centro, y Arganzuela) y a nueve barrios situados en el arco noroeste-sureste que bordea el distrito Centro, en paralelo al río Manzanares. Se ganó en parques urbanos, espacios intermedios entre bloques ajardinados, carril bici, un bulevar central, edificios dotacionales, sin coste para la municipalidad. El coste en términos de patrimonio industrial, sin embargo, ha sido elevado: muchas fábricas desaparecidas, algunas de ellas de interés arquitectónico, tipológico, cultural y paisajístico, varios edificios reutilizados sin mucha sensibilidad, y escaso el patrimonio, no solamente ferroviario, tangible que reclama hoy mayores niveles de protección y de control de cara a futuras actuaciones.
