O presente trabalho revisa e discute aspectos legais e jurisprudências sobre a rescisão unilateral por parte do compromissário comprador de contratos de compra e venda de bem imóvel sob alienação fiduciária, a partir de uma disposição teórica. Considerando que se trata de uma relação de consumo, também são apresentadas e discutidas as proposições do artigo 53 do Código de Defesa do Consumidor, que dispõem serem nulas de pleno direito as cláusulas que estabeleçam a perda total das prestações pagas pelo promitente comprador, em caso de inadimplemento e rescisão contratual. A presente questão ainda gera controvérsia no meio jurídico. No entanto, o tema encontra-se pacificado pela Súmula 543 do Superior Tribunal de Justiça (STJ), que, por cautela, estabeleceu a restituição total ou parcial das parcelas pagas, de forma recíproca entre o promitente comprador e o promitente vendedor/construtor, na hipótese de resolução contratual. A partir do estudo, propõe-se uma reflexão sobre a possibilidade de o compromissário comprador rescindir contrato de compra e venda garantido em alienação fiduciária, mediante reembolso das parcelas já pagas em prestações sucessivas do contrato, bem como a verificação da possibilidade de aplicação do litisconsórcio necessário entre o promitente vendedor e a instituição financeira.
