Resumo Em espaços públicos, a circulação e permanência de corpas dissidentes é, muitas vezes, inviabilizada. A violência exercida de forma institucional e a perseguição têm aumentado, regredindo avanços consideráveis na pauta LGBTI+. Olÿmpia é um bar que visa à ocupação de ambientes da cidade por essas sujeitas, além de permitir sua empregabilidade. Essa pesquisa busca refletir, a partir de casos de transfobia ocorridos nesse estabelecimento, sobre a eficácia da judicialização e de políticas públicas que se propõem a abarcar esse segmento da população. Utiliza-se uma abordagem jurídico-sociológica, pelas vertentes da teoria queer, decolonial e transfeministas, para interpretar essas manifestações do “cistema”.
A criminalização da homotransfobia representa um avanço para a pauta LGBTI+, no entanto, a proteção de quem é vítima de tal violência ainda está limitada a certo perfil e ignora realidades sociais relevantes que inviabilizam a concretização de seus objetivos. A partir de dados de registro de ocorrência coletados pela Polícia Civil do Rio de Janeiro, do Instituto de Segurança Pública, do Rio Sem Homofobia e do Grupo Arco Íris, que foram sistematizados pela Aliança Nacional LGBTI, busca-se compreender algumas lacunas deixadas pela aplicação da lei que criminaliza o racismo e esses casos, assim como os impasses ainda existentes para a efetiva proteção de pessoas LGBTI+ por agentes públicos. Utiliza-se uma abordagem jurídico-sociológica a partir da teoria queer, decolonial e transfeminista.

O presente artigo busca, a partir de pesquisas antropológicas e da análise de atos normativos e documentos oficiais de quando vigorava o modelo integracionista, compreender de que forma essa imposição de valores ditos universais incluía na ‘adequação’ de indígenas ao‘desenvolvimento’ a cis-heteronormatividade, ou seja, a naturalização da heterossexualidade, a cisgeneridade e seus modos de vida enquanto norma e fundamento coerente para viver em sociedade. Não se pretende uniformizar o processo colonizador ou compreender como se davaessa dinâmica nesses povos anteriormente ao contato com europeus, mas buscar, nesses documentos, diretrizes de imposição de cis-heteronormatividade imbricada a outros processos de reificação de quem estava sendo colonizado.
