Transactie Monitoring Utility: Private samenwerking in de strijd tegen witwassen Prof. mr. M. Nelemans en mr. G.M. Verhage* InleidingAfgelopen zomer presenteerden de minister van Financiën en de minister van Justitie en Veiligheid een plan van aanpak voor de bestrijding van witwassen en onderliggende criminaliteit (hierna: het 'plan'). 1 Een van de onderdelen van het plan is het mogelijk maken van een Transactie Monitoring Utility (hierna: 'TM Utility') die banken in staat zou stellen om informatie over transacties samen te brengen in een aparte organisatie die de uitvoering van de gezamenlijke monitoring verricht.Vijf Nederlandse banken hebben op 13 september jl. publiekelijk de ambitie uitgesproken om inderdaad samen te gaan werken bij het monitoren van transacties. 2 Zij zien voordelen in een vorm van gezamenlijke transactiemonitoring in de strijd tegen witwassen en terrorismefinanciering.In het navolgende wordt kort de TM Utility besproken en wordt ingegaan op de belofte hiervan. * Prof. mr. De TM UtilityDe ambitie van de banken tot de introductie van een TM Utility komt niet uit de lucht vallen. Banken liggen onder een vergrootglas bij hun controle op crimineel geldverkeer. Dit heeft ook reeds tot strafrechtelijke onderzoeken geleid. 3Opgemerkt zij dat de TM Utility slechts als een van de mogelijkheden wordt gepresenteerd om meer grip op crimineel geldverkeer te krijgen. De TM Utility is ingebed in een breder palet aan maatregelen. In het plan worden verschillende voorstellen gedaan, verdeeld over de volgende drie categorieën: 1. Het verhogen van barrières voor het witwassen van vermogen. Zo wordt vanaf 2020 het UBO-register ingevoerd dat misbruik van juridische entiteiten en constructies moet bemoeilijken door meer transparantie te bieden over de personen die achter de entiteiten en structuren schuilgaan. Verder worden aanbieders van cryptowallets en omwisselplatforms onder de Wwft gebracht. 2. Het vergroten van de effectiviteit van de poortwachtersfunctie en het toezicht daarop.
