Resumo: Este artigo discute decisão do Tribunal de Justiça do Rio Grande do Sul (TJRS) que, mesmo diante da tendência a decisões judiciais que declaram a inconstitucionalidade da lei municipal que aprova o Plano Diretor sem prévia audiência pública, acatou a constitucionalidade quando se tratava de município que não está obrigado a elaborar o respectivo Plano Diretor. Diante do processo acelerado e desorganizado de urbanização brasileiro, o planejamento estratégico de organização das cidades é fundamental para a garantia do bem-estar dos munícipes. Nesse contexto, é indiscutível a relevância da participação social no procedimento de elaboração e revisão dos Planos Diretores, a qual, além de promover uma gestão democrática das cidades, contribui para organizá-las. O método empregado na pesquisa é o Estudo de Caso com suporte em consulta bibliográfica.
