El artículo se enfoca en las causas y características del discurso xenofóbico en contextos de migraciones forzadas en sus diferentes expresiones a partir de las perspectivas abiertas por el Análisis Crítico del Discurso propuesto por T. Van Dijk, a los fines de evidenciar las características y alcances del citado discurso en sus distintas dimensiones, el contexto donde son emitidos y su expresión como formas de prácticas sociopolíticas. Desde una visión alternativa frente al discurso xenofóbico, se analizan los aportes de la ética de la hospitalidad, a partir de su formulación en el pensamiento de Daniel Innerarity, como una plataforma de solución para la acogida de migrantes en contextos de migraciones forzadas y se establecen unas bases reflexivas para su contextualización en relación con discursos y prácticas presentes en la realidad actual de Colombia.
This book introduces an analysis of the interrelationships among democracy, judiciary and human rights. It uses the notion of democratic legitimacy as a central concept to think the following: some aspects of language; the ontic of morals related to human rights; minimal conditions of democratic power as an argumentative representation; and, tension between democracy and constitutional pre-commitments related to judiciary power which performs a legal inspection of the law. It concludes with the necessity to adapt a weak substantivist model in order to state a democratic constitutionalism.
