The socio-environmental function of the genetically modified plants patents This inter-disciplinary study focus the social-environmental issues associated to land use and to the conservation of nature in view of the current Brazilian legislation and within a Political Ecology perspective. In particular, it is dedicated to Modern Biotechnology and Law. More specifically, we analyzed the protection of plants through patent rights [industrial property rights] in contraposition to the obligation to comply with the socio-environmental function. As a follow-up of the abyssal line theory proposed by Boaventura de Souza Santos, we look for a deepening of the socio-environmental perspective of the problems related to Modern Biotechnology. We verified if the socio-environmental aspects are being considered by the legislation, and which are the implications of this relation. This study was developed through literature and documental search, as much in Modern Biotechnology as in Law. It is expected that this study contributes with subsidies to the defense of the most basic human interests, hit by the results of genetic sciences and their applications in modern agriculture in Brazil.
RESUMO Este artigo tem por objetivo revisar o Princípio de Precaução no ordenamento nacional ante os acordos internacionais assumidos pelo Brasil. Optamos por uma abordagem constitucional na fase introdutória, pois Princípio de Precaução, que emerge do artigo 225 da Constituição Federal, é considerado como Princípio Geral do Direito Ambiental. O artigo está dividido em três itens. No primeiro deles, como introdução, sugerimos um panorama da sua inserção no direito ambiental brasileiro a partir das convenções internacionais. O segundo item refere-se à sua incorporação pela a doutrina jurídica brasileira. No terceiro, apresentamos alguns exemplos da sua [in]eficácia no contexto nacional. As considerações finais evocam a urgência de uma postura precautória.
ResumoNeste artigo discutimos o direito humano à alimentação concebido em termos culturais ligados a um "território", mais especificamente, à Terra Indígena [TI] Pimentel Barbosa de ocupação Xavante, localizada no Estado de Mato Grosso, Brasil. Na primeira parte do artigo, procuramos demonstrar que à alimentação do povo Xavante estão vinculados importantes processos culturais, simbólicos e cosmológicos que se comunicam com modos de pertencer a um "território". Já a situação de insegurança alimentar apresentada nesta segunda etapa do artigo, aponta para algo mais do que fragilidade nas condições de sua sobrevivência. Implica, sobretudo, numa condição política negada, já que é retirada dos Xavante seu próprio mundo, ou o "Ró" [ou cerrados, mundo, tudo], que é a condição de sua existência como A'uwe [ou povo]. Estamos falando, portanto, de um jogo simbólico muito mais amplo e que leva à destruição dos sentidos sociais desse povo. Assim, insegurança alimentar, desnutrição e altos índices de mortalidade infantil, são sintomas de um problema mais basal, que por sua vez evidencia o uso desigual do amplo "território" brasileiro. Por este motivo, falar do atual contexto de "subalternidade alimentar" do povo Xavante significa também falar da supressão das condições mínimas de sua expressão social em Ró. Na terceira parte, abordamos as possibilidades de os direitos humanos serem colocados ao serviço de uma política emancipatória em relação aos Xavante sobre as possibilidades de uma concepção multicultural dos direitos humanos. Ressalvamos que, ao menos no contexto brasileiro, o diálogo parece uma noção desesperadamente fraca em relação à cultura Xavante. As conclusões finais levam a proposta de que as terras indígenas Xavante voltem a ter sua configuração de território contínuo unindo as terras indígenas através dos cerrados restituindo, ao menos em parte, a territorialidade indígena.
