O objetivo deste artigo é analisar as principais características do pensamento de Olympe de Gouges e Mary Wollstonecraft, demonstrando sua importância para o início do movimento feminista e, consequentemente, da luta pelos direitos das mulheres. Neste sentido, o primeiro capítulo aborda, inicialmente, a grande obra de Olympe de Gouges, a Declaração dos Direitos da Mulher e da Cidadã, que pretendeu garantir diversos direitos fundamentais às mulheres, em pleno contexto revolucionário da França do final do século XVIII. Já o segundo capítulo estuda a obra Reivindicação dos Direitos das Mulheres, escrita pela inglesa Mary Wollstonecraft, quase que simultaneamente à Declaração de Olympe e que pode ser considerada um dos documentos fundadores do próprio feminismo.
Este artigo tem por objetivo apresentar os principais aspectos do debate travado entre John Rawls e Chantal Mouffe sobre o melhor modelo de democracia a ser aplicado na sociedade contemporânea, marcada pelo pluralismo. Com este intuito, uma primeira seção faz um breve estudo sobre a teoria de justiça formulada por John Rawls e suas implicações no campo político. A segunda seção, por sua vez, analisa as críticas feitas por Chantal Mouffe ao modelo teórico desenvolvido por Rawls e apresenta o modelo proposto pela pensadora belga, chamado por ela mesma de modelo radical de democracia. RESUMO Este artigo aborda um dos temas mais relevantes da Filosofia do Direito contemporânea: o desenvolvimento de uma teoria da justiça dentro de um contexto social absolutamente fragmentado. De um modo geral, três importantes escolas participam deste debate de forma mais atuante: os liberais, os comunitaristas e os crítico-deliberativos. Assim, o objetivo deste trabalho é identificar e analisar os principais pontos de discordância entre as três correntes, especificamente no que se refere à definição de uma teoria da justiça. Neste sentido, foram utilizados como referência três importantes pontos: primeiro, a questão do pluralismo contemporâneo; em seguida, a complexa relação entre direitos individuais e soberania popular; e, por fim, a hermenêutica constitucional. ResumoEste artigo possui como pano de fundo o debate sobre a existência de uma sociedade cosmopolita e a consequente inadequação dos atuais modelos políticos, que ainda se fundamentam no poder exercido pelos Estados-Nações. Para os autores que sustentam tal afirmação, os Estados-Nações não são mais capazes de suprir as demandas de uma sociedade cada vez mais globalizada, sendo necessário, por este motivo, uma reforma das instituições políticas tradicionais, visando à formação de uma real "governança global". Neste sentido, o artigo apresenta as ideias de alguns destes autores, como ABSTRACT This article has as its background the debate about the existence of a cosmopolitan society and the consequent inadequacy of the current political models, which are still based on the power exercised by the Nations-States. For the authors who support this statement, Nation-States are no longer able to meet the demands of an increasingly globalized society, and for this reason a reform of traditional political institutions is necessary, aiming at the formation of a real "global governance". Este tema, decerto, não pode ser considerado uma novidade, na medida em que, ao final do século XVIII, em 1795, Kant já afirmava, em "A Paz Perpétua" que a única possibilidade de uma paz permanente entre os Estados era através do cosmopolitismo. De uma forma mais abrangente, pode-se dizer que, atualmente, este debate sobre o cosmopolitismo gira em torno de duas vertentes: a primeira é aquela que defende a existência de princípios morais ou culturais que são válidos universalmente, independentemente das fronteiras estatais. Esta ideia fundamenta, em especial, as teorias que sustentam a universalidade dos direitos humanos. A segunda vertente do cosmopolitismo, por sua vez, concentra suas atenções na questão política. Seus defensores acreditam que os Estados-Nações não são mais capazes de suprir as demandas de uma sociedade cada vez mais globalizada, sendo necessário, por este motivo, a construção de uma estrutura política que atendesse a essa nova realidade. Essa estrutura, em princípio, estaria fundamentada na reforma das instituições políticas tradicionais, formando uma espécie de "governança global" (CITTADINO; DUTRA, 2013). Ao longo das últimas décadas, diversos autores abordaram esta questão, formulando modelos políticos que privilegiam o aspecto global, em detrimento do tradicional modelo democrático que encontra um limite, ou ao menos uma referência, na existência dos Estados-Nações.
